Should women be able to profit from false rape accusations?

Here’s an interesting story. (H/T Stuart Schneiderman)

Now that Brian Banks has been exonerated of a rape conviction that put him in prison for five years, the one-time prep football star has a message for NFL coaches: Give him a chance.

[…]t was the plan he left outside a prison door when he pleaded no contest to a childhood friend’s false accusation of rape in 2002, a claim she has now recanted.

The hearing that changed Banks’ life took only minutes. Los Angeles Deputy District Attorney Brentford Ferreira said his office conceded the case should be dismissed. Superior Court Judge Mark C. Kim concurred and quickly announced it was over.

One of his first moves was to report to the probation office to have the electronic monitoring ankle bracelet removed — a felon no longer.

Banks said he is ready to move forward and is trying not to be angry.

“I couldn’t ask for more today,” he told reporters after Thursday’s hearing. “But there is always the question of why did it have to happen in the first place? Why wasn’t I heard with the truth of what happened when I was 16?”

Even after he was released from prison, he could not get work because he was a registered sex offender and had a felony record.

Before the charges, Banks was a star middle linebacker at Long Beach Polytechnic High School and was attracting interest from college football powerhouses as the University of Southern California, Ohio State University and the University of Michigan, according to the website Rivals.com, which tracks the recruiting of high school football and basketball players.

He verbally agreed to a full scholarship at USC.

Then, a teenage girl he had known since childhood claimed he had raped her. He was arrested and, on advice of counsel, pleaded no contest to rape and an enhancement of kidnapping in order to avoid a possible life sentence if tried by a jury.

[…]The key, said Brooks, was the woman’s admission she had lied. And it came out of the blue.

After serving five years and two months in prison, Banks was released, and a strange thing happened. Wanetta Gibson, the woman who claimed he had attacked her on the high school campus when she was 15, contacted him on Facebook and asked to meet with him.

He recalled being stunned. “I thought maybe it wasn’t real. How could she be contacting me?”

He said he knew that if he became angry when he met with her it wouldn’t help, so he struggled to keep calm.

“I stopped what I was doing and got down on my knees and prayed to God to help me play my cards right,” he said.

In two meetings, she said she had lied and offered to help him clear his name, but there was a catch. She did not want to return a $1.5 million payment from a civil suit brought by her mother against the Long Beach schools.

She refused to repeat her new story to prosecutors but they accepted the account which had been secretly videotaped by the defense.

It was uncertain whether Gibson will have to return the money and unlikely she would be prosecuted for making the false accusation so long ago.

How common are these false rape accusations, though?

Studies show about 40-50 percent of rape accusations are false

False accusations of rape or sexual assault are commonly used by women to get attention and sympathy, or to get an alibi when they’ve done something wrong, or to get revenge on someone.

Here’s a Fox News article from a prominent equity feminist, Wendy McElroy.

“Forty-one percent of all reports are false.”

This claim comes from a study conducted by Eugene J. Kanin of Purdue University. Kanin examined 109 rape complaints registered in a Midwestern city from 1978 to 1987.

Of these, 45 were ultimately classified by the police as “false.” Also based on police records, Kanin determined that 50 percent of the rapes reported at two major universities were “false.”

Although Kanin offers solid research, I would need to see more studies with different populations before accepting the figure of 50 percent as prevalent; to me, the figure seems high.

But even a skeptic like me must credit a DNA exclusion rate of 20 percent that remained constant over several years when conducted by FBI labs. This is especially true when 20 percent more were found to be questionable.

False accusations are not rare. They are common.

If you would like to get an idea of how false rape accusations are handled by the police, here is an example. Usually no charges are filed, or if charges are filed, then they get off without jail time. (But the accused men can go to jail for years, see below)

False accusations in divorce trials

False accusations of domestic violence and sexual abuse are also commonly made during divorce settlements in order to get custody of the children, and the attendant benefits.

Consider this article from Touchstone magazine, by Stephen Baskerville.

Today it is not clear that we have learned anything from these miscarriages of justice. If anything, the hysteria has been institutionalized in the divorce courts, where false allegations have become routine.

What is ironic about these witch-hunts is the fact that it is easily demonstrable that the child abuse epidemic—which is very real—is almost entirely the creation of feminism and the welfare bureaucracies themselves. It is well established by scholars that an intact family is the safest place for women and children and that very little abuse takes place in married families. Child abuse overwhelmingly occurs in single-parent homes, homes from which the father has been removed. Domestic violence, too, is far more likely during or after the breakup of a marriage than among married couples.

Yet patently false accusations of both child abuse and domestic violence are rampant in divorce courts, almost always for purposes of breaking up families, securing child custody, and eliminating fathers. “With child abuse and spouse abuse you don’t have to prove anything,” the leader of a legal seminar tells divorcing mothers, according to the Chicago Tribune. “You just have to accuse.”

Among scholars and legal practitioners it is common knowledge that patently trumped-up accusations are routinely used, and virtually never punished, in divorce and custody proceedings. Elaine Epstein, president of the Massachusetts Women’s Bar Association, writes that “allegations of abuse are now used for tactical advantage” in custody cases. The Illinois Bar Journal describes how abuse accusations readily “become part of the gamesmanship of divorce.” The UMKC Law Reviewreports on a survey of judges and attorneys revealing that disregard for due process and allegations of domestic violence are used as a “litigation strategy.” In the Yale Law Review, Jeannie Suk calls domestic violence accusations a system of “state-imposed de facto divorce” and documents how courts use unsupported accusations to justify evicting Americans from their homes and children.

The multi-billion dollar abuse industry has become “an area of law mired in intellectual dishonesty and injustice” writes David Heleniak in the Rutgers Law Review. Domestic violence has become “a backwater of tautological pseudo-theory,” write Donald Dutton and Kenneth Corvo in the scholarly journal Aggression and Violent Behavior. “No other area of established social welfare, criminal justice, public health, or behavioral intervention has such weak evidence in support of mandated practice.”

I often hear men, especially men in the church, complaining that young men won’t get married because they are too busy watching porn and playing video games. But maybe the real reason is that they don’t want to be exposed to domestic violence laws and divorced courts that are waiting to separate them from their earnings. And they can already get sex for free before marriage. If the church isn’t speaking out against premarital sex (to women) and against no-fault divorce and against biased domestic violence laws, then they have no one to blame for the so-called “marriage strike” but themselves.

Domestic violence rates

Here’s a recent article in the liberal UK Guardian that summarizes the evidence.

Domestic violence has traditionally been understood as a crime perpetrated by domineering men against defenceless women. Research spanning over 40 years has, however, consistently found that men and women self-report perpetrating domestic violence at similar rates. Professor John Archer from the University of Central Lancashire has conducted a number of meta-analytic reviews of these studies and found that women are as likely to use domestic violence as men, but women are twice as likely as men to be injured or killed during a domestic assault. Men still represent a substantial proportion of people who are assaulted, injured or killed by an intimate partner (50%, 30% and 25% respectively).

If the empirical research is correct in suggesting that between a quarter and half of all domestic violence victims are men, a question follows: why has women’s domestic violence towards men been unreported for so long, and what has changed in the last five years to make it more visible?

One reason may be the feminist movement. Feminism took up the cause of domestic abuse of women in the 1970s, with the world’s first women’s refuge being opened by Erin Pizzey in 1971. Feminism understood domestic violence as the natural extension of men’s patriarchal attitudes towards women, leading men to feel they had the right to control their partners, using violence if necessary. Feminists campaigned successfully to bring the issue into the public arena, thereby securing resources to establish services to help victims. This activism and advocacy led to governmental and public acceptance that “domestic violence” was synonymous with violence against women.

[…]The dual stereotypes of the violent man and passive woman have undoubtedly obscured the existence of male victims of domestic violence in the past. Men were also unlikely to view their own victimisation as either domestic violence or a criminal assault, and so were unlikely to seek help.

Large sums of money have been spent on educational campaigns to encourage female victims to seek help. Until there are similar campaigns for men, it is unlikely that the true number of male victims needing help will be known. If the current trends continue however, women may find themselves increasingly likely to be charged with domestic assault, and men more likely to be offered help and protection.

I wonder how many women believe the official feminist line on domestic violence? The raw numbers are so rarely discussed.

Who is to blame for this woman’s troubles? Well, I agree with Driscoll that her family, the church and other Christians were to blame for not telling her the truth about sex. On that we all agree. Christians do a lousy job of explaining sex to young people, because they don’t want to talk about “dirty” stuff, and they don’t want to use arguments and evidence, and they don’t want to go outside the Bible to give real reasons and evidence. But thumping the Bible is a poor response to peer pressure and pop culture.

But she and Mark Driscoll also seem to think the man is to blame. Is the man to blame?

Well, the man certainly did bad things, but I think that none of these bad things could have happened to this woman in particular if this woman had not first chosen this man from all the other men that she knew, and then given him the opportunity to do these bad things. Without her own free choices, she would never have been harmed. So her own bad choices played a part in her suffering but she didn’t mention her own choices at all. So, let me take a look at how she could have made better choices below.

Can women expect a non-Christian man to act like a Christian man?

Women need to be careful to realize that they should avoid being alone with non-Christian men, especially when they are not even old enough to be dating men at all. That’s what courting is designed to prevent, by the way – the man has to go through the father to get to the woman, and they need to be accompanied by a chaperone at all times. And in any case, a woman can get love without touching a man just by listening to the man’s words, reading his writings, letting him serve her, washing a car together, and accepting gifts from him.

Women: you don’t go to a deserted beach with a non-Christian man. Don’t take risks like that. Especially when you have probably already done a lot with the guy. And don’t drink alcohol, it impairs your judgment. The purpose of men is to marry them, not to have a good time with them. No alcohol is allowed!

Paul says that you cannot expect non-Christians to act like Christians, which is exactly what many Christian women do.

1 Cor 5:9-13:

9I have written you in my letter not to associate with sexually immoral people—

10not at all meaning the people of this world who are immoral, or the greedy and swindlers, or idolaters. In that case you would have to leave this world.

11But now I am writing you that you must not associate with anyone who calls himself a brother but is sexually immoral or greedy, an idolater or a slanderer, a drunkard or a swindler. With such a man do not even eat.

12What business is it of mine to judge those outside the church? Are you not to judge those inside?

13God will judge those outside. “Expel the wicked man from among you.”

And, 2 Cor 6:14-16:

14Do not be yoked together with unbelievers. For what do righteousness and wickedness have in common? Or what fellowship can light have with darkness?

15What harmony is there between Christ and Belial? What does a believer have in common with an unbeliever?

16What agreement is there between the temple of God and idols? For we are the temple of the living God. As God has said: “I will live with them and walk among them, and I will be their God, and they will be my people.”

Christians should not pursue non-Christians romantically – it’s disrespectful to God to leave him out of your romantic operations.

Women can stop a lot of the bad behavior of men just by choosing authentic Christian men by using rigorous objective criteria to evaluate men. If a woman chooses a non-Christian man, then she cannot complain if he acts like a non-Christian man. And there is more to a man being a Christian than just saying that he is, memorizing Bible verses and singing praise hymns in church. Christianity is a worldview. It has to be applied across the board. Christian women need to study to develop a Christian worldview of their own so they know how to evaluate the worldviews of candidate men.

What else can we learn from the video?

Here are a few more things that stood out to me in the video:

  • She should take more responsibility for their actions, instead of blaming others
  • She should study these things (not just the Bible!) on her own before she starts dating, to know why God puts these boundaries in place to protect her from harm
  • Her parents should have studied these things (not just the Bible!) more, and helped her more by being more convincing, to know why God puts these boundaries in place to protect her from harm
  • The church she grew up in should provide her with extra-biblical arguments and evidence from the objective external world so that she could resist ideologies like atheism, postmodernism, liberalism, feminism, etc. – she can’t act morally unless she believes that God exists and that morality is real

Women should also know that the decision to have sex before marriage with a man who isn’t a Christian doesn’t magically change him into a Christian. Sex isn’t magic. It doesn’t cause a man to like a woman, or to fall under her control.

Women go to school for 4 years to learn a trade and they need to put some effort into studying courtship rules so they can be wise about their own choices with men. Jumping into a car and trying to drive it without lessons is a good way to get killed. And emotions, intuitions, peer-pressure and pop-culture don’t help you to know how to drive a car. Be careful, think for yourself.

I also recommend that young, unmarried women  become informed about anti-family, anti-father policies. If women don’t want to be hurt by men, then vote for stronger families, lower taxes, and policies that promote good husbands and good fathers. Girls need to see love modeled between a husband and wife as they grow up, and they need to have fathers in the home. Good public policies encourage men to marry and stay married.

Women need to get better criteria for choosing men

A while back, I posted on some of the criteria women have for choosing men, and here are a few:

  • Being tall
  • Being aloof and disinterested
  • Playing a musical instrument
  • Well-dressed
  • Stylish shoes
  • A deep voice
  • Handsome face

What do women expect when they choose men based on criteria like that? It makes no sense to blame a bad man for being bad. He’s BAD! Don’t go near him, he’ll be bad to you, too!

Shouldn’t women judge themselves first, before judging a man?

Shouldn’t women begin by removing the plank in their own eye before removing the speck from the man’s eye?

I think an excellent first step would be for Christian women to take a good look at the music they listen to, the movies they watch, and also what they read. Are they listening to Melissa Etheridge, watching “Thelma & Louise”, and reading Margaret Atwood? Are they informing themselves about truth in many areas, like economics and cosmology, so that they can make informed choices of men? Are they building resistance to cultural trends?

What is wrong with the woman in that video?

Shouldn’t this woman have put some effort into testing out the claims of her parents and the church by reading the Bible itself? I mentioned reading extra-biblical stuff but even the Bible doesn’t ground anything that she was doing or anything the church was telling her to do that was wrong. Driscoll seems to think that women are not obligated to read the Bible, and that if someone in the church tells them a lie, then the church is to blame. But shouldn’t we expect people who attend church to test these things out for themselves? I realize that she wasn’t a Christian, but in order to take responsibility, she could have said “I should have checked things in my Bible and so I share the blame”. She doesn’t say that because she doesn’t blame herself at all for anything that happened. Well, probably she went to church for the singing and never read what the Bible had to say – or didn’t take it as an authority. But she never blames herself for either one of those.

I noticed that she claims that if the church tells her something and she does it, then the church is to blame. Well, the church (or at least her parents) undoubtedly told her not to have sex before she was married, but she didn’t mention that in the video. Why not? Well, she only mentions things that other people tell her to blame them. When they tell her the right thing and she doesn’t do it, she doesn’t mention what they told her. Because she won’t blame herself for any reason. And Driscoll has nothing to say about that, either.  Any time the church tells her something bad and she does it… it’s the church’s fault. Any time the church tells her something good and she DOESN’T do it… she just doesn’t mention it because she isn’t responsible for anything she does – it’s always the fault of someone else.

I don’t mind if she explains the circumstances surrounding WHY she made bad choices. I don’t even mind the bad choices, because I make bad choices. I just don’t like her blaming other people, I especially don’t like her blaming bad men. Bad men are bad. Don’t blame them for not being good – it’s your fault for choosing them. There are other men who are good who get no attention from women at all.

We need to learn from Theodore Dalrymple

With increasing frequency I am consulted by nurses, who for the most part come from and were themselves traditionally members of (at least after Florence Nightingale) the respectable lower middle class, who have illegitimate children by men who first abuse and then abandon them. This abuse and later abandonment is usually all too predictable from the man’s previous history and character; but the nurses who have been treated in this way say they refrained from making a judgment about him because it is wrong to make judgments.

And again:

Why are the nurses so reluctant to come to the most inescapable of conclusions? Their training tells them, quite rightly, that it is their duty to care for everyone without regard for personal merit or deserts; but for them, there is no difference between suspending judgment for certain restricted purposes and making no judgment at all in any circumstances whatsoever. It is as if they were more afraid of passing an adverse verdict on someone than of getting a punch in the face—a likely enough consequence, incidentally, of their failure of discernment. Since it is scarcely possible to recognize a wife beater without inwardly condemning him, it is safer not to recognize him as one in the first place.

This failure of recognition is almost universal among my violently abused women patients, but its function for them is somewhat different from what it is for the nurses. The nurses need to retain a certain positive regard for their patients in order to do their job. But for the abused women, the failure to perceive in advance the violence of their chosen men serves to absolve them of all responsibility for whatever happens thereafter, allowing them to think of themselves as victims alone rather than the victims and accomplices they are. Moreover, it licenses them to obey their impulses and whims, allowing them to suppose that sexual attractiveness is the measure of all things and that prudence in the selection of a male companion is neither possible nor desirable.

Read the whole thing, you young women. And judge men hard. It’s good to judge them beforehand so that you don’t have to condemn them for being bad later.

First, I want every one to take a look at this verse on providing for a family  in context: (1 Tim 5:3-8)

 3 Give proper recognition to those widows who are really in need.

4 But if a widow has children or grandchildren, these should learn first of all to put their religion into practice by caring for their own family and so repaying their parents and grandparents, for this is pleasing to God.

5 The widow who is really in need and left all alone puts her hope in God and continues night and day to pray and to ask God for help.

6 But the widow who lives for pleasure is dead even while she lives.

7 Give the people these instructions, so that no one may be open to blame.

8 Anyone who does not provide for their relatives, and especially for their own household, has denied the faith and is worse than an unbeliever.

10 I rejoiced greatly in the Lord that at last you renewed your concern for me. Indeed, you were concerned, but you had no opportunity to show it. 

11 I am not saying this because I am in need, for I have learned to be content whatever the circumstances.

12 I know what it is to be in need, and I know what it is to have plenty. I have learned the secret of being content in any and every situation, whether well fed or hungry, whether living in plenty or in want.

13 I can do all this through him who gives me strength.

 14 Yet it was good of you to share in my troubles. 

15 Moreover, as you Philippians know, in the early days of your acquaintance with the gospel, when I set out from Macedonia, not one church shared with me in the matter of giving and receiving, except you only; 

16 for even when I was in Thessalonica, you sent me aid more than once when I was in need. 

17 Not that I desire your gifts; what I desire is that more be credited to your account. 

18 I have received full payment and have more than enough. I am amply supplied, now that I have received from Epaphroditus the gifts you sent. They are a fragrant offering, an acceptable sacrifice, pleasing to God. 

19 And my God will meet all your needs according to the riches of his glory in Christ Jesus.

Now I want to talk about a very disturbing trend that I see in the church. I see a lot of women who are not prepared to choose men who are going to fill this provider role. Men have a role, straight from the Bible, to provide for their wife and children, and to donate to support evangelistic efforts. And providing is not predicated on how a man makes a woman feel. Providing is based on the things such as:

  • working for money before you are legally able to work for money
  • working summer jobs during high school and college
  • working during college or doing college degrees while working full-time
  • doing consulting work or running your own business from home in the evenings
  • studying science, technology, engineering and math (no exceptions!)
  • not drinking alcohol or smoking cigarettes – no addictions of any kind
  • not spending money on hair, tattoos, clothes, shoes or flashy junk
  • own your own car, and keep it well-maintained
  • own your own pet, and keep it healthy and well-trained
  • pay your rent or mortgage payments on time
  • carry no debt, borrow no money
  • avoid depending on government welfare or student loans
  • not taking sick days, not getting sick at all
  • purchasing resources for others, especially things like apologetics books, to build them up
  • giving charity to solid Christian speakers and funding apologetics events (William Lane Craig debates)
  • making investments in stocks or real estate
  • maxing out 401K contributions and Roth IRAs
  • taking women out on dates, driving them in the man’s own car, and paying for everything
  • spending money to help the pro-life and pro-marriage causes (Morse, Klusendorf)

And I think you have to give bonus marks for getting up early, although I can’t do that. I know someone who does, though – the hardest working software engineer I know.

Women should not prefer young men who are studying political science, psychology, English, education, grievance studies, and other non-quantitative subjects which do not equip a man to provide enough salary and savings to run a Christian life plan (homeschooling or private Christian schools or both). What ends up happening is that there is a lot of fighting over money, especially with women who don’t have savings of their own before marrying. Without money, the children will likely get pushed into public school and they influenced by secularism and leftism.

What to do? Pick a man with a proven record of taking his responsibilities to study and earn seriously.

I think that marrying someone who is not in one of these careers makes no sense at all, especially in light of a global recession.

And just to be clear, this is an area I struggle in myself. I am great at working for money, and saving it and investing it. But I say a lot of controversial things and a lawsuit would not be good for my fortune. I should be spending more time on evenings and weekends keeping my skills up, and that’s what I’m going to be doing on my vacation. But I think the standard stands regardless of my own abilities to meet it. It is the standard.

Money is an important part of the Christian life. The Bible says that if a man does not work, neither shall he eat. We have a tradition on what men are supposed to do in Christianity. Men are supposed to take care of business, and women are supposed to prefer men with proven records of taking care of business. Being handsome and fun is nowhere in the Bible as a qualification for men to be good husbands and fathers. But earning money and providing for others in the community is a non-negotiable requirement. It’s as required as the obligation to not marry a non-Christian man.

Women who are serious about Christianity will prefer men who meet the specifications laid out in the Bible. And this has to have been demonstrated over the course of years – a pattern of studying hard things, working multiple jobs, spending little, saving much and supporting family and evangelism.  To me, a woman who prefers a man who has no record of providing is a woman who has been influenced by feminism. She rejects the traditional roles of men and insists on a man who is has no authority to lead because he does not have the provider role. That’s what’s really going on here. Men who earn have authority to lead and hold a woman accountable when she misbehaves, and some women hate being led and being held accountable. (By being held accountable I mean disagreeing with the woman, canceling optional goodies, etc.)

I think we have a major problem in this society, and in the church, where we think that women are above criticism. We think that anything they feel like doing is a good idea. We think that their complete lack of rational thought and lack of planning in relationships is somehow “romantic”. We think that women who embrace spontaneity and ignorance of statistical data are “free spirits”. Is it any wonder that the out-of-wedlock birth rate is 42%, the divorce rate for first time marriages is 45%, and women are shacking up with unqualified men instead of getting married?

This is all – all – caused by the fact that women have no idea what men are for, and they deliberately prefer non-judgmental, non-theologically-exclusive, non-rational, tolerant, intuitive, wusses instead of men who give them hard books to read and who hold them accountable when they misbehave. Women today think it is a bad thing when a man holds her accountable when she disrespects him in public, but think it is a good thing to date a man who asks his parents to borrow the car keys before taking her out. Huh? I had a current year car with only 7500 miles on it at age 17 – because I was working two jobs in high school, and part-time IT/desktop publishing in my own business on the side.

Women who are interested in testing a man’s abilities can use my checklist for finding authentic Christian women. Those questions work on men too.
