State of Utah lists 15 consequences to redefining marriage in appellate brief

In an historic opening brief filed yesterday before the U.S. Court of Appeals for the Tenth Circuit, the state of Utah identified at least 15 consequences of redefining marriage to include same-sex couples. You can read the full text, which justifies more fully why each of these reasons are valid.

Here are some of their reasons:

1. “First, as many commentators have observed, because procreation is an inherently gendered affair, redefining marriage in genderless terms would break the critical conceptual link between marriage and procreation. . . . Given the manifest ills of fatherless parenting, the State has a compelling interest in sending a powerful message to women that, whenever possible, marriage to the fathers of their children is very important to the welfare of those children and to society itself.”

5. “Fifth, and most obviously, a genderless definition of marriage would likely increase the number of children being raised by same-sex parents. That could happen because the couple decides to raise together an existing child of one of the partners. Or it could result from the conception of a new child through surrogacy or sperm-donation. Either way, such children will not benefit from the State’s preferred mother-father parenting model; often they will have no way of knowing even the identity of both biological parents. And recent evidence on same-sex parenting, while not conclusive, indicates that same-sex parenting arrangements are less effective than married biological mothers and fathers in producing positive outcomes in the lives of their children.

8. “[The] correlation between genderless marriage and lower birthrates. . . . It is also striking that fertility and birthrates tend to be markedly lower in nations and states that have embraced same-sex marriage.”

12. “Governments would likely be pressured—and perhaps agree—to revoke the tax-exempt status of churches or other non-profit religious organizations that refuse on religious grounds to recognize same-sex marriages or to provide benefits to same-sex couples on the same terms as husband-wife couples.”

13. “Governments would likely be pressured—and perhaps agree—to investigate, prosecute and punish people in wedding-related businesses for refusing on religious conscience grounds to assist with same-sex weddings.”

14. “Government licensing agencies would likely be pressured—and perhaps agree—to investigate and punish counselors for refusing on religious conscience grounds to counsel same-sex married couples on the same terms as heterosexual couples.”

15. “Religion-based conflicts between public schools and parents would likely increase as children are taught about sexuality and marriage in ways that contravene parents’ and students’ deeply held religious beliefs.”

These reasons are all of interest to the state, but what about the other social consequences of redefining marriage?

Ryan T. Anderson wrote about that a while back.

The Norm of Monogamy. New York University Professor Judith Stacey has expressed hope that redefining marriage would give marriage “varied, creative and adaptive contours,” leading some to “question the dyadic limitations of Western marriage and seek…small group marriages.”[5] In their statement “Beyond Same-Sex Marriage,” more than 300 “LGBT and allied” scholars and advocates call for legal recognition of sexual relationships involving more than two partners.[6]

University of Calgary Professor Elizabeth Brake thinks that justice requires using legal recognition to “denormalize[] heterosexual monogamy as a way of life” and “rectif[y] past discrimination against homosexuals, bisexuals, polygamists, and care networks.” She supports “minimal marriage” in which “individuals can have legal marital relationships with more than one person, reciprocally or asymmetrically, themselves determining the sex and number of parties, the type of relationship involved, and which rights and responsibilities to exchange with each.”[7]

And:

The Norm of Exclusivity. Andrew Sullivan, who has extolled the “spirituality” of “anonymous sex,” also thinks that the “openness” of same-sex unions could enhance the bonds of husbands and wives:

[A]mong gay male relationships, the openness of the contract makes it more likely to survive than many heterosexual bonds.… [T]here is more likely to be greater understanding of the need for extramarital outlets between two men than between a man and a woman.… [S]omething of the gay relationship’s necessary honesty, its flexibility, and its equality could undoubtedly help strengthen and inform many heterosexual bonds.[11]

“Openness” and “flexibility” are Sullivan’s euphemisms for sexual infidelity. Similarly, in a New York Times Magazine profile, gay activist Dan Savage encourages spouses to adopt “a more flexible attitude” about allowing each other to seek sex outside their marriage.[12] The New York Times recently reported on a study finding that exclusivity was not the norm among gay partners: “‘With straight people, it’s called affairs or cheating,’ said Colleen Hoff, the study’s principal investigator, ‘but with gay people it does not have such negative connotations.’”[13]

We really need to think about the consequences of these decisions before we jump into them. The last time we redefined marriage, it was no-fault divorce. That worked out great for selfish adults who wanted to make marriage about their own happiness and feelings, but it didn’t work out well for the children who were impacted.

The 50 worst countries for anti-Christian persecution

Kirsten Powers explains in the leftist Daily Beast, of all places.

In their annual report of the worst 50 countries for Christian persecution, Open Doors found that Christian martyr deaths around the globe doubled in 2013.  Their report documented 2,123 killings, compared with 1,201 in 2012. In Syria alone, there were 1,213 such deaths last year. In addition to losing their lives, Christians around the world continue to suffer discrimination, imprisonment, harassment, sexual assaults, and expulsion from countries merely for practicing their faith.

Once again, the worst persecutor of Christians is North Korea, where an estimated 50,000 to 70,000 followers of Jesus are suffering in prison camps for “crimes” such as owning a Bible, going to church, or sharing their faith. In November 2013, it was reported that 80 prisoners were publicly executed, many for possessing Bibles. Last year, North Korea sentenced an American missionary, Kenneth Bae to 15 years of hard labor in a prison camp.

[…]It’s chilling to imagine worse treatment than what the average North Korean prisoner has reported, including a mother forced to drown her own baby in a bucket, and tales of subsisting on nothing more than rats and insects. According to first-hand accounts from former prisoners reported by Amnesty International, “every former inmate at one camp had witnessed a public execution, one child was held for eight months in a cube-like cell so small he couldn’t move his body and an estimated 40% of inmates die from malnutrition.”

Syria, ranked as the third-worst country by Open Doors, has devolved in the last year to a horror show for Christians. The Hudson Institute’s Nina Shea noted in December 2013 a message she received from a contact in Syria who reported, “Kidnapping, killings, ransom, rape . . . 2013 is a tragedy for Christians in Syria. All Syrians have endured great suffering and distress. The Christians, however, often had to pay with their lives for their faith. Our bishops and nuns have been kidnapped, our political leader killed by torture. After our Christian villages have been occupied, our churches have been destroyed and even mass graves were found in Saddad. [T]he Islamists have put [to] the Christians the alternative: Islam or death. Why [is] the West just watching?”

Some of the most harrowing stories about how Christians are persecuted have come from the African country of Eritrea, which Open Doors lists as the twelfth worst country in the world for Christian persecution. In his 2013 book, The Global War on Christians, reporter John L. Allen Jr., writes that in Eritrea, Christians are sent to the Me’eter military camp and prison, which he describes as a “concentration camp for Christians.” It is believed to house thousands being punished for their religious beliefs.

Prisoners are packed into 40’x38’ metal shipping containers, normally used for transporting cargo. It is so cramped that it’s impossible to lie down and difficult even to find a place to sit. “The metal exacerbates the desert temperatures, which means bone chilling cold at night and wilting heat during the day….believed to reach 115 degrees Fahrenheit or higher,” Allen writes. One former inmate…described [it] as “giant ovens baking people alive.” Prisoners are given next to nothing to drink so “they sometimes end up drinking their own scant sweat and urine to stay alive.” The prisoners are tortured, sexually abused, and have no contact with the outside world. One survivor of the prison described witnessing a fellow female inmate “who had been beaten so badly her uterus was actually hanging outside her body. The survivor desperately tried to push the uterus back in” but couldn’t prevent the inmate’s excruciating death.

Lately, I’ve been blogging quite a lot about the difference between the Judeo-Christian morality and atheist morality. Christians have a objective standard to condemn what is going on in these other countries. Christians believe in human rights. Christians believe in religious liberty. Christians are grieved when we hear about these crimes being committed against followers of Jesus. On the Judeo-Christian view, every human being is made to be in a relationship with God – a relationship that lasts into eternity. That means that when Christians see someone in distress, we are rationally compelled to try to try to help them. In fact, the earliest Christians used to take in abandoned babies, because of that reasoning. If Christianity is true, then what these people are doing to persecute Christians for their beliefs is really wrong.

But on atheism, you can’t condemn violence against Christians in other countries as wrong:

Rule #1: Relativists Can’t Accuse Others of Wrong-Doing

Relativism makes it impossible to criticize the behavior of others, because relativism ultimately denies that there is such a thing as wrong- doing. In other words, if you believe that morality is a matter of personal definition, then you can’t ever again judge the actions of others. Relativists can’t even object on moral grounds to racism. After all, what sense can be made of the judgment “apartheid is wrong” when spoken by someone who doesn’t believe in right and wrong? What justification is there to intervene? Certainly not human rights, for there are no such things as rights. Relativism is the ultimate pro-choice position because it accepts every personal choice—even the choice to be racist.

And that’s why in the secular mainstream media, crimes like this are seldom talked about. Secularists have no basis to condemn these actions, they would rather crusade for late-term abortion and same-sex marriage, which is nothing but the celebration of the selfishness of adults at the expense of children.

SCOTUS Justice grants stay for some from Obamacare pro-abortion mandate

This article from NBC News reports on a development in some of the cases being brought by Christian organizations against the Obama administration.

Supreme Court Justice Sonia Sotomayor granted a last-ditch plea from Catholic groups Tuesday night to block a birth control mandate in the new health care law for religious organizations, just hours before it was to have gone into effect.

Sotomayor issued the stay at the request of an order of Catholic nuns in Colorado, part of a larger effort by Catholic-affiliated groups from around the nation to halt provisions of the Affordable Care Act that require companies — regardless of religious beliefs — to provide contraceptives and other abortion-inducing drugs to their employees.

The groups wanted the mandate halted while the court considers a legal challenge, brought by the for-profit company Hobby Lobby, arguing that the requirement violates their religious liberties.

In June, the 10th U.S. Circuit Court of Appeals in Denver waived millions of dollars of fines against Hobby Lobby and a subsidiary, Mardel Christian Stores, which refused to comply with the mandate, writing that the companies were likely to win their claim that requiring for-profit companies to pay for birth control was a violation of religious protections.

The motion for a stay went to Sotomayor as the justice with oversight for the 10th Circuit. She gave the government until Friday to respond.

“Tomorrow, a regulatory mandate will expose numerous Catholic organizations to draconian fines unless they abandon their religious convictions and take actions that facilitate access to abortion-inducing products, contraceptives, sterilization, and related education and counseling for their employees,” the groups said in their request for a stay Tuesday.

The mandate requires companies run by Christians to provide their employees coverage for drugs that can cause abortions  by preventing the implantation of a fertilized egg.

The big case that everyone is watching is the Hobby Lobby case, and they were granted a stay from a federal court back in July of 2013. Their case is headed to the U.S. Supreme Court, where the government will argue that Christians should be forced to subsidize abortion, in violation of their consciences.
