Should government get out of the marriage business?

Dina sent me three articles by Jennifer Roback Morse, post on The Public Discourse. The articles answer the charge from social liberals and libertarians that we should “get the government out of marriage”.

Here’s the first article which talks about how government will still be involved in marriage, even if we get rid of the traditional definition of marriage, because of the need for dispute resolution in private marriage contracts. She uses no-fault divorce as an example showing how it was sold as a way to get government out of the divorce business. But by making divorce easier by making it require no reason, it increased the number of disputes and the need for more government to resolve these disputes.

Here’s the second article which talks about how the government will have to expand to resolve conflicts over decisions about who counts as a parent and who gets parental rights. With traditional marriage, identifying who the parents are is easy. But with private marriage contracts where the parties are not the biological parents, there is a need for the state to step in and assign parental rights.

Here’s the third article which talks about how marriage is necessary in order to defend the needs and rights of the child at a time when they cannot enter into contracts and be parties to legal disputes.

The third article was my favorite, so here is an excerpt from it:

The fact of childhood dependence raises a whole series of questions. How do we get from a position of helpless dependence and complete self-centeredness, to a position of independence and respect for others? Are our views of the child somehow related to the foundations of a free society? And, to ask a question that may sound like heresy to libertarian ears: Do the needs of children place legitimate demands and limitations on the behavior of adults?

I came to the conclusion that a free society needs adults who can control themselves, and who have consciences. A free society needs people who can use their freedom, without bothering other people too much. We need to respect the rights of others, keep our promises, and restrain ourselves from taking advantage of others.

We learn to do these things inside the family, by being in a relationship with our parents. We can see this by looking at attachment- disordered children and failure-to-thrive children from orphanages and foster care. These children have their material needs met, for food, clothing, and medical care. But they are not held, or loved, or looked at. They simply do not develop properly, without mothers and fathers taking personal care of them. Some of them never develop consciences. But a child without a conscience becomes a real problem: this is exactly the type of child who does whatever he can get away with. A free society can’t handle very many people like that, and still function.

In other words I asked, “Do the needs of society place constraints on how we treat children?” But even this analysis still views the child from society’s perspective. It is about time we look at it from the child’s point of view, and ask a different kind of question. What is owed to the child?

Children are entitled to a relationship with both of their parents. They are entitled to know who they are and where they came from. Therefore children have a legitimate interest in the stability of their parents’ union, since that is ordinarily how kids have relationships with both parents. If Mom and Dad are quarreling, or if they live on opposite sides of the country, the child’s connection with one or both of them is seriously impaired.

But children cannot defend their rights themselves. Nor is it adequate to intervene after the fact, after harm already has been done. Children’s relational and identity rights must be protected proactively.

Marriage is society’s institutional structure for protecting these legitimate rights and interests of children.

I recommend taking a look at all three articles and becoming familiar with the arguments in case you have to explain why marriage matters and why we should not change it. I think it is important to read these articles and to be clear that to be a libertarian doctrine does not protect the right of a child to have a relationship with both his or her parents.  Nor does libertarianism promote the idea that parents ought to stick together for their children.

The purpose of marriage is to make adults make careful commitments, and restrain their desires and feelings, so that children will have a stable environment with their biological parents. We do make exceptions, but we should not celebrate exceptions and we should not subsidize exceptions. It’s not fair to children to have to grow up without a mother or father just so that they adults can make poor, emotional decisions and have fun.

Jerry Walls lectures on objections to Calvinism

WARNING: This lecture is a very sharp and pointed critique of Calvinist theology. Viewer discretion is advised. 

In Protestant Christianity, there is a division between people who accept Calvinist doctrines and those who don’t. Both groups think that the other group are genuine Christians, but the debate has more to do with the human free will, human responsibility and who God loves.

Dr. Walls is Protestant (like me). He is a substance dualist (like me). And he believes in a real eternal Hell (like me). And he is very, very assertive. Definitely no confidence problems here. And you’re not going to have a problem keeping your attention on this lecture!

He quotes at least a half-dozen Calvinist theologians in this lecture, including John Piper, J.I. Packer and D.A. Carson. And he also mentions 3 videos at the end of the lecture where he goes over specific Bible verses that seem to support Calvinism (part 4, part 5, part 6 are the ones he mentioned).

This lecture is very strong stuff, and I think that he could have been nicer when presenting it, but he hit on every single objection that I have to Calvinism, and he worked through my reasoning too! So I really liked that he validated all of my concerns about Calvinism. I’m not as bothered about the problems with Calvinism as he is, though. I don’t think it’s a big divisive issue. I almost always read Calvinist theologians when I am reading theology. I just conjoin Calvinism with middle knowledge and resistible grace, and it’s fine. Calvinists are some of the best theologians, they are just wrong on the things he discusses in his lecture.

U.S. Department of Justice arguing that homeschooling is not a right

In 1938, the practice of homeschooling was outlawed in Germany by Adolf Hitler and the infamous Third Reich. It was a rough period in German history, as thousands of young people were being pried from their parents’ direction and authority and drafted into the Hitler Youth program, where they were supposed to be trained as Aryan supermen (and women). In a few short years, vast numbers of these youth would be bleeding out on the battlefields of Europe, on the wrong side of the war for the soul of the world.

Sadly for freedom and for many families, Germany has never lifted this archaic and totalitarian ban on homeschooling. On the contrary, the German government seems to have stepped up its opposition to homeschooling over the past decade, forcing several families to flee, and others to enroll their children in state-approved schools against their will. The German Supreme Court has stated that the purpose of the homeschooling ban is to, “counteract the development of religious and philosophically motivated parallel societies.” It sounds like they aren’t really big on religious or philosophical diversity over there.

Some notable victims of this small-minded and grasping totalitarianism are Uwe and Hannelore Romeike and their five children. Uwe and his wife are music teachers and evangelical Christians who for years have been unsuccessfully seeking the right to homeschool their children. The Romeikes withdrew their children from German public schools in 2006, after becoming concerned that the educational material employed by the school was undermining the tenets of their Christian faith, and that the school was not providing their children with an ideal learning environment. “I don’t expect the school to teach about the Bible,” Mr. Romeike said, but “part of education should be character-building.”

After accruing the equivalent of around $10,000 in fines, and facing police visits to their home and the forcible removal of their children from the home, the Romeikes fled Germany in 2008 to seek asylum in the land of the free and the home of the brave. Their case was taken up by the Homeschool Legal Defense Association (HSLDA), which helped the Romeikes in 2010 to become the first family ever granted asylum in the US for the protection of their homeschooling rights.

The HSLDA explains, “The U.S. law of asylum allows a refugee to stay in the United States permanently if he can show that he is being persecuted for one of several specific reasons. Among these are persecution for religious reasons and persecution of a ‘particular social group.’ ”

On January 26, 2010, Memphis federal immigration judge Lawrence Burman granted the Romeikes political asylum, ruling they had a reasonable fear of persecution for their beliefs if they returned to their homeland. Judge Burman also denounced the German policy heatedly. In a statement, he called it, “utterly repellent to everything we believe as Americans.”

[…]The Romeikes were able to continue quietly homeschooling their children in a small Tennessee town. For a time.

Sadly, their period of respite was not to last. The Romeikes’ case is now before the United States Court of Appeals for the Sixth Circuit, with the US government seeking to revoke their asylum and force them to return to Germany. And the details of Attorney-General Holder’s arguments in the brief for Romeike v. Holder are sinister, to say the least.

According to Holder, parents have no fundamental right to home-educate their children.

Please read the whole thing. It always amazes me that people who voted for secularism and leftism claim to be Christians. If you are trying to raise your children to be authentic, effective Christians, then you do not promote any law or policy that takes away your right to pull them out of schools that are not partnering with YOUR GOALS. Christians should never vote to vote a public school system that not only is at odds with Christianity and morality, but may not even be doing a good job of teaching math, science and technology correctly. We need to have the option to opt out of attending failing schools. I think we should even have the option to opt out of FUNDING failing schools. I am opposed to mandatory taxation for homeschooling parents.
