UK Supreme Court rules against Christian B&B couple’s conscience rights

Dina sent me this article from the UK Telegraph about a recent Supreme Court decision from the UK.

The devoutly Christian owners of a Cornish hotel who refused to allow two gay men to take a double room have lost their final appeal to the Supreme Court. It ruled that Peter and Hazelmary Bull had discriminated against the couple, even though they had long operated a rule that unmarried guests had to sleep apart. One of the judges, Lady Hale, said such a case would have been unthinkable less than two decades ago, and it is a measure of how both the law and societal norms have changed that the Bulls should have found themselves in such a predicament.

It is also a pity this matter was not settled amicably when the Bulls made an offer of redress; but campaigners were intent on making an example of them. The aggrieved men, Martyn Hall and Steven Preddy, who were in a civil partnership, were supported by the Equalities and Human Rights Commission (EHRC). The Bulls were perplexed as to why the EHRC should act against them, since their right to exercise their religious beliefs was being set against that of the men not to be discriminated against on the grounds of their sexual orientation.

[A]s the systematic unequal treatment of gays has ended, so another problem has grown. One pernicious social force has been replaced by another: the willingness of the state to outlaw minority or eccentric views and behaviours. State-backed oppression has yielded to state-backed intolerance.

The Bulls have been hauled before the courts and told they can no longer practise what they preach. To deny a couple the right to make a living in a manner consistent with their Christian values is draconian. The Bulls’ fate is similar to that of Lillian Ladele, an Islington marriage registrar, and Gary McFarlane, a Relate counsellor, who were both sacked after declining to provide their professional services to lesbians and gays. Equality laws did for them all.

The problem here is not, as it appears, merely a slap in the face to Christians. It is a slap in the face to the right of all individuals to act free of state control absent a compelling reason for intervention. As John Stuart Mill put it in On Liberty (1859): ‘The only purpose for which power can be rightfully exercised over any member of a civilised community, against his will, is to prevent harm to others.’

As if to satisfy Mill’s harm principle, the Supreme Court went in search of Preddy and Hall’s ‘harm’. What they found was that when the Bulls’ house rules were explained to Preddy and Hall, they found it ‘upsetting’ and ‘very hurtful’. Even in the touchy-feely twenty-first century, where self-esteem is seen as so important and so fragile, this is pretty lame.

The Supreme Court judge, Lady Hale, may have been aware that this ‘affront to their dignity’, as she put it, was not the sort of harm, in the Mill sense, that should justify the state’s coercive power. She bolstered her argument by linking Preddy and Hall’s hurt feelings to a bigger historical picture. ‘We should not underestimate’, she said, ‘the continuing legacy of those centuries of discrimination, persecution even, which is still going on in many parts of the world’.

Fascism happens when the normal desire for compassion is taken out of the family context and becomes the policy of a powerful feminist welfare state. And that’s when it becomes a threat to the right of individuals to make moral judgments and to exercise religious liberty.

The EHRC, you’ll remember, was a project of the Labour Party of the UK, which is the socialist party in the UK. There is also a communist party called the Liberal Democrats. The striking thing is that many church-attending Christians not only vote for the Labour Party, but they also vote for the Liberal Democrats, which are even more liberal. A lot of this is because British Christians are so far to the left on economic issues that they sort of go along with the assault on their own religious liberty out of ignorance. They vote for bigger and bigger government, and then they are surprised when they actually get it.

The same thing happened in Canada with the Liberal Party and their introduction of Human Rights Commissions and Human Rights Tribunals, which criminalize offending people with free speech. The very Christians that voted for expanding government to reduce poverty were the ones who were then persecuted by the same big government they voted to create. This goes to show why we need to have better economics knowledge among Christians, because many of us are voting for left-wing parties because we think that private, voluntary charity can be replaced with government-controlled redistribution of wealth. Not only does that not work to reduce poverty, but in the end, we lose our liberties, too.

In the UK, you’ll find a lot of Christians who think that rent control is a good thing, that price controls are a good thing, that raising minimum wage is a good thing, that tariffs on imported goods are a good thing – positions which are generally viewed as incorrect by academic economists across the ideological spectrum. That’s why churches need to teach the Christian worldview, including economics. The UK church should be training Christians to undo this ignorant, patriotic confidence that UK Christians have in their welfare state. We all have a lot of work to do to educate ourselves on how the Bible applies to the real world (e.g. – economics), or else we will end up undermining our own liberties.

Additionally, I find it very frustrating that so many churches are so focused on providing emotional comfort and a sense of community to the people in the pews that they neglect to talk about these religious liberty issues. Pastors don’t want to alert ordinary Christians about how dangerous it’s becoming to take unpopular stands on issues like gay rights in public – it’s scary and divisive and drives people away from church. You’re not going to hear them trying to apply the Bible to moral issues or economic issues, etc. from the pulpit, because that spoils the “experience” and “the show” – the comfort and entertainment that people expect from church. We need to do better at helping Christians to be aware of threats to our liberties. They need to be trained to connect their faith to specific laws and policies in the real world.

Mark Steyn and Thomas Sowell on “the knockout game”

In his book The Abolition of Man, he writes of “men without chests” — the chest being “the indispensable liaison” between the head and the gut, between “cerebral man” and “visceral man.” In the chest beat what Lewis calls “the trained emotions.” Without them there is no honor or virtue, but only “intellect” and/or “appetite.”

Speaking of appetite, have you played the “Knockout” game yet? Groups of black youths roam the streets looking for a solitary pedestrian, preferably white (hence the alternate name “polar-bearing”) but Asian or Hispanic will do. The trick is to knock him to the ground with a single punch. There’s a virtually limitless supply of targets: In New York, a 78-year-old woman was selected, and went down nice and easy, as near-octogenarian biddies tend to when sucker-punched. But, when you’re really rockin’, you can not only floor the unsuspecting sucker but kill him: That’s what happened to 46-year-old Ralph Santiago of Hoboken, N.J., whose head was slammed into an iron fence, whereupon he slumped to the sidewalk with his neck broken. And anyway the one-punch rule is flexible: In upstate New York, a 13-year-old boy socked 51-year-old Michael Daniels but with insufficient juice to down him. So his buddy threw a bonus punch, and the guy died from cerebral bleeding. Widely available video exists of almost all Knockout incidents, since the really cool thing is to have your buddies film it and upload it to YouTube. And it’s so simple to do in an age when every moronic savage has his own “smart phone.”

There’s no economic motive. The 78-year-old in New York was laden with bags from department stores, but none were touched. You slug an elderly widow not for the 50 bucks in her purse but for the satisfaction of seeing her hit the pavement. In response, some commentators are calling for these attacks to be recategorized: As things stand, if white youths target a black guy it’s a hate crime, but vice versa is merely common assault. I doubt this would make very much difference. “No justification of virtue will enable a man to be virtuous,” wrote Lewis — and, likewise, no law can prevent a thug punching an old lady to the ground if the thug is minded to. “A society’s first line of defense is not the law but customs, traditions, and moral values,” wrote Professor Walter Williams a few years ago. “They include important thou-shalt-nots such as shalt not murder, shalt not steal, shalt not lie and cheat, but they also include all those courtesies one might call ladylike and gentlemanly conduct. Policemen and laws can never replace these restraints on personal conduct.”

Restraint is an unfashionable concept these day, but it is the indispensable feature of civilized society. To paraphrase my compatriot George Jonas, punching a spinster’s lights out isn’t wrong because it’s illegal, it’s illegal because it’s wrong. But, in a world without restraints, what’s to stop you? If a certain percentage of your population feels no moral revulsion at randomly pulverizing fellow citizens for sport, a million laws will avail you naught: The societal safety lock is off.

The main reason for many people’s surprise is that the mainstream media have usually suppressed news about the “knockout game” or about other and larger forms of similar orchestrated racial violence in dozens of cities in every region of the country. Sometimes the attacks are reported, but only as isolated attacks by unspecified “teens” or “young people” against unspecified victims, without any reference to the racial makeup of the attackers or the victims — and with no mention of racial epithets by the young hoodlums exulting in their own “achievement.”

Despite such pious phrases as “troubled youths,” the attackers are often in a merry, festive mood. In a sustained mass attack in Milwaukee, going far beyond the dimensions of a passing “knockout game,” the attackers were laughing and eating chips, as if it were a picnic.

One of them observed casually, “white girl bleed a lot.”

[…]Some in the media, as well as in politics, may think that they are trying to avoid provoking a race war by ignoring or playing down these attacks. But the way to prevent a race war is by stopping these attacks, not trying to sanitize them.

If these attacks continue, and continue to grow, more and more people are going to know about them, regardless of the media or the politicians. Responsible people of all races need to support a crackdown on these attacks, which can provoke a white backlash that can escalate into a race war. But political expediency leads in the opposite direction.

What is politically expedient is to do what Attorney General Eric Holder is doing — launch campaigns against schools that discipline a “disproportionate” number of black male students. New York City’s newly elected liberal mayor is expected to put a stop to police “stop and frisk” policies that have reduced the murder rate to one-fourth of what it was under liberal mayors of the past.

I think that the biggest cause of crime in this society is fatherlessness, which we not only refuse to judge on moral grounds, but which we actually subsidize with our taxpayer dollars.

Dr. Michael Tanner of the libertarian Cato Institute explains one of the causes of fatherlessness in his testimony to Congress:

Welfare contributes to crime in several ways. First, children from single-parent families are more likely to become involved in criminal activity. According to one study, children raised in single-parent families are one-third more likely to exhibit anti-social behavior.(3) Moreover, O’Neill found that, holding other variables constant, black children from single- parent households are twice as likely to commit crimes as black children from a family where the father is present. Nearly 70 percent of juveniles in state reform institutions come from fatherless homes, as do 43 percent of prison inmates.(4) Research indicates a direct correlation between crime rates and the number of single-parent families in a neighborhood.(5)

As Barbara Dafoe Whitehead noted in her seminal article for The Atlantic Monthly:

The relationship [between single-parent families and crime] is so strong that controlling for family configuration erases the relationship between race and crime and between low income and crime. This conclusion shows up time and again in the literature. The nation’s mayors, as well as police officers, social workers, probation officers, and court officials, consistently point to family break up as the most important source of rising rates of crime.(6)

At the same time, the evidence of a link between the availability of welfare and out-of-wedlock births is overwhelming. There have been 13 major studies of the relationship between the availability of welfare benefits and out-of-wedlock birth. Of these, 11 found a statistically significant correlation. Among the best of these studies is the work done by June O’Neill for the U.S. Department of Health and Human Services. Holding constant a wide range of variables, including income, education, and urban vs. suburban setting, the study found that a 50 percent increase in the value of AFDC and foodstamp payments led to a 43 percent increase in the number of out-of-wedlock births.(7) Likewise, research by Shelley Lundberg and Robert Plotnick of the University of Washington showed that an increase in welfare benefits of $200 per month per family increased the rate of out-of-wedlock births among teenagers by 150 percent.(8)

The same results can be seen from welfare systems in other countries. For example, a recent study of the impact of Canada’s social-welfare system on family structure concluded that “providing additional benefits to single parents encourages births of children to unwed women.”(9)

So what can we do? We can bring back moral judgments. I think that we have to get to the point in society where we realize that all of this permissiveness about “forgiving” people who fail to be responsible with sexuality and marriage actually does harm to society. When you refuse to pass judgment on premarital sex and divorce, and even make it financially lucrative for the people who engage in it (single mother welfare, alimony, child support) then you get more fatherless children, not less.

Although it is tempting to want to be liked for being “compassionate”, we have to look beyond our feelings and our vanity and start to think about the big picture. We need to shame people who are unchaste. We need to shame single mothers. We need to shame people who divorce and blame them for marrying badly. We need to cut off all the subsidies for people who make decisions that deprive children of their fathers. We need to stop the normalization of premarital sex that occurs in our schools. We need to shame women who choose men for sex when those men are not capable of being husbands and fathers.

More Americans collecting welfare than working full-time

At the end of 2011, the last year for which data are available, some 108.6 million people received one or more means-tested government benefit programs — bureaucratese for welfare.

Meanwhile, there were just 101.7 million people with full-time jobs, the Census data show, including both the private and government sectors.

This is a real danger for the U.S. — the danger of dependency. Anytime more people are being paid not to work than to work, it imperils our democracy. No one votes to cut his own welfare benefits. So welfare grows.

[…]According to official data from the government, 46.5 million people live in poverty in the U.S. Doing the quick math, that means just 43% of all those on welfare are officially considered poor.

When you add in other government programs with a check attached — Social Security, Medicare, veterans benefits, unemployment and other non-means-tested benefits — you find a whopping 151 million Americans get a check from the government other than an income-tax refund.

[…]A Cato Institute study in August found that welfare now pays more than minimum-wage work in 35 states. Indeed, the federal government has 126 separate programs to help low-income earners.

“The current welfare system provides such a high level of benefits that it acts as a disincentive for work,” the study said. “Welfare currently pays more than a minimum-wage job in 35 states, even after accounting for the Earned Income Tax Credit, and in 13 states it pays more than $15 per hour.”

Given all the disincentives, it seems as if the government doesn’t even want people to work. But why would that be?

Perhaps it’s in the interest of those on the so-called progressive left — those most responsible for the uncontrolled growth of the welfare state — to keep Americans out of work and dependent on government.

Sure looks that way. After all, for Democrats, dependent voters are reliable voters.

In fact, we’ve spent $3.7 trillion on welfare over the last 5 years.

Where did the money come from? Well, all this subsidized dependency has been going on, we have been adding 6.5 trillion to the national debt. Our national debt is now up to $17 trillion – more than our entire Gross Domestic Product! The national debt will have to be paid back by future generations of Americans. So what we are really doing here is transferring money from children who can’t vote to adults who can vote. That’s what the Democrat Party is doing with all of this spending.

This program of inter-generational theft amounts to enslaving the next generation. You could even view the public schools as complicit in it, since they are teaching young people to value giving the public schools more money. It’s like brainwashing a victim of abuse to believe that the abuse is normal. By the time the young people wake up and realize that they are eating grass while their “educators” dine on caviar, it will be too late. This is not surprising since the Democrats are the part of slavery, historically speaking. Maybe we need to start using rhetoric like that so that people understand what is really going on.
