Who halted the FBI investigation of Hillary’s private unsecure e-mail server?

That’s the question I’ve been asking myself: who killed the FBI investigation of Hillary’s e-mail server and the Clinton Foundation?

Former attorney general Michael Mukasey has an answer to the question in the Wall Street Journal.

First a quick review of the facts:

Nonetheless, in July [FBI director Comey] announced that “no reasonable prosecutor” would seek to charge [Hillary Clinton] with a crime, although Mrs. Clinton had classified information on a private nonsecure server—at least a misdemeanor under one statute; and although she was “extremely careless” in her handling of classified information such that it was exposed to hacking by hostile foreign nations—a felony under another statute; and apparently had caused the destruction of emails—a felony under two other statutes. He then told Congress repeatedly that the investigation into her handling of emails was closed.

Those decisions were not his to make, nor were the reasons he offered for making them at all tenable: that prosecutions for anything but mishandling large amounts of classified information, accompanied by false statements to investigators, were unprecedented; and that criminal prosecutions for gross negligence were constitutionally suspect.

Members of the military have been imprisoned and dishonorably discharged for mishandling far less information, and prosecutions for criminal negligence are commonplace and entirely permissible. Yet the attorney general [Loretta Lynch], whose decisions they were, and who had available to her enough legal voltage to vaporize Mr. Comey’s flimsy reasons for inaction, told Congress she would simply defer to the director.

That July announcement of Mr. Comey, and that testimony by Attorney General Loretta Lynch, also had a history.

When the FBI learned that two of the secretary’s staff members had classified information on their computers, rather than being handed grand-jury subpoenas demanding the surrender of those computers, the staff members received immunity in return for giving them up. In addition, they successfully insisted that the computers not be searched for any data following the date when Congress subpoenaed information relating to its own investigation, and that the computers be physically destroyed after relevant data within the stipulated period was extracted.

The technician who destroyed 30,000 of Mrs. Clinton’s emails after Congress directed that they be preserved lied to investigators even after receiving immunity. He then testified that Clinton aides requested before service of the subpoena that he destroy them, and that he destroyed them afterward on his own initiative.

Why would an FBI director, who at one time was an able and aggressive prosecutor, agree to such terms or accept such a fantastic story?

 

Yes, why did Comey stop the FBI investigation of Hillary Clinton given all of these facts?

Mukasey explains who called off the investigation and why:

The search for clues brings us to an email to then-Secretary Clinton from President Obama, writing under a pseudonym, that the FBI showed to Ms. Abedin. That email, along with 21 others that passed between the president and Secretary Clinton, has been withheld by the administration from release on confidentiality grounds not specified but that could only be executive privilege.

After disclosure of those emails, the president said during an interview that he thought Mrs. Clinton should not be criminally charged because there was no evidence that she had intended to harm the nation’s security—a showing required under none of the relevant statutes. As indefensible as his legal reasoning may have been, his practical reasoning is apparent: If Mrs. Clinton was at criminal risk for communicating on her nonsecure system, so was he.

That presented the FBI director with a dilemma that was difficult, but not complex. It offered two choices. He could have tried to proceed along the course marked by the relevant laws. The FBI is powerless to present evidence to a grand jury, or to issue grand-jury subpoenas. That authority lies with the Justice Department, headed by an attorney general who serves, as her certificate of appointment recites, “during the pleasure of the President of the United States for the time being.”

[…]Instead, Mr. Comey acceded to the apparent wish of President Obama that no charges be brought. 

Obama would have wanted the FBI investigation stopped because if the Department of Justice decided that Clinton “was at criminal risk” for communicating on Clinton’s nonsecure system, then so was he. Fortunately for Obama, he appointed Loretta Lynch as attorney general, and we know she won’t prosecute Democrats, because she refused to go after the IRS for persecuting conservative organizations ahead of the 2012 election, so that Obama would win.

So, did Obama know that he was communicating to Secretary Clinton on an unsecure private e-mail server?

His own staff sent e-mails confirming that he knew.

The far-left New York Times reports:

In a March 2015 interview, President Obama said that he had learned about Hillary Clinton’s use of a private email server as secretary of state “the same time everybody else learned it, through news reports.”

But that assertion concerned aides of Mrs. Clinton, who knew that the president himself had received emails from the private address, according to a hacked email made public on Tuesday by WikiLeaks.

“We need to clean this up — he has emails from her — they do not say state.gov,” Cheryl D. Mills, a top aide, wrote to John D. Podesta, another senior adviser, on March 7, 2015.

Two days later, Mr. Obama’s spokesman, Josh Earnest, tried to clarify the president’s remarks, saying that he had, in fact, exchanged emails with Mrs. Clinton through her private account.

And far left CNN confirms:

A top Hillary Clinton adviser said President Barack Obama’s answer on Clinton’s private email use as secretary of state needed “clean up,” according to hacked emails from her campaign chairman released Tuesday.

In a March 2015 email chain, Cheryl Mills, a top legal adviser and longtime member of Clinton’s inner circle, told campaign Chairman John Podesta of an interview in which Obama said he learned about Clinton’s private email setup from news reports.

“We need to clean this up — he has emails from her — they do not say state.gov,” Mills wrote to Podesta.

So, who ordered the FBI to stop investigating Hillary’s private e-mail server? Who ordered the Department of Justice not to proceed with the criminal investigation? Obama was the one with the authority to call it off, and Obama had a reason for calling it off: he was at risk of criminal charges himself.

That headline is sensational, but consider this article by Andy McCarthy in National Review.

It says:

Hillary and her husband, former president Bill Clinton, operated the Clinton Foundation. Ostensibly a charity, the foundation was a de facto fraud scheme to monetize Hillary’s power as secretary of state (among other aspects of the Clintons’ political influence). The scheme involved (a) the exchange of political favors, access, and influence for millions of dollars in donations; (b) the circumvention of campaign-finance laws that prohibit political donations by foreign sources; (c) a vehicle for Mrs. Clinton to shield her State Department e-mail communications from public and congressional scrutiny while she and her husband exploited the fundraising potential of her position; and (d) a means for Clinton insiders to receive private-sector compensation and explore lucrative employment opportunities while drawing taxpayer-funded government salaries.

While the foundation did perform some charitable work, this camouflaged the fact that contributions were substantially diverted to pay lavish salaries and underwrite luxury travel for Clinton insiders. Contributions skyrocketed to $126 million in 2009, the year Mrs. Clinton arrived at Foggy Bottom. Breathtaking sums were “donated” by high-rollers and foreign governments that had crucial business before the State Department. Along with those staggering donations came a spike in speaking opportunities and fees for Bill Clinton. Of course, disproportionate payments and gifts to a spouse are common ways of bribing public officials — which is why, for example, high-ranking government officeholders must reveal their spouses’ income and other asset information on their financial-disclosure forms.

While there are other egregious transactions, the most notorious corruption episode of Secretary Clinton’s tenure involves the State Department’s approval of a deal that surrendered fully one-fifth of the United States’ uranium-mining capacity to Vladimir Putin’s anti-American thugocracy in Russia.

Here are the details about the donations:

In a nutshell, in 2005, under the guise of addressing the incidence of HIV/AIDS in Kazakhstan (where the disease is nearly nonexistent), Bill Clinton helped his Canadian billionaire pal Frank Giustra to convince the ruling despot, Nursultan Nazarbayev (an infamous torturer and human-rights violator), to grant coveted uranium-mining rights to Giustra’s company, Ur-Asia Energy (notwithstanding that it had no background in the highly competitive uranium business). Uranium is a key component of nuclear power, from which the United States derives 20 percent of its total electrical power.

In the months that followed, Giustra gave an astonishing $31.3 million to the Clinton Foundation and pledged $100 million more. With the Kazakh rights secured, Ur-Asia was able to expand its holdings and attract new investors, like Ian Telfer, who also donated $2.35 million to the Clinton Foundation. Ur-Asia merged with Uranium One, a South African company, in a $3.5 billion deal — with Telfer becoming Uranium One’s chairman. The new company proceeded to buy up major uranium assets in the United States.

[…][L]ater, it was announced that Russia’s Rosatom had purchased 17 percent of Uranium One.

Later on:

[…][T]he Russian company sought to acquire a controlling interest in Uranium One. That would mean a takeover not only of the Kazakh mines but of the U.S. uranium assets as well. Such a foreign grab requires approval by the Committee on Foreign Investment in the United States, a powerful government tribunal that the secretary of state sits on and heavily influences. Though she had historically postured as a hawk against foreign acquisitions of American assets with critical national-security implications, Secretary Clinton approved the Russian takeover of Uranium One. During and right after the big-bucks Russian acquisition, Telfer contributed $1.35 million to the Clinton Foundation. Other people with ties to Uranium One appear to have ponied up as much as $5.6 million in donations.

Does this sound unbelievable? Well consider this article from the far left New York Times, of all places.

The headline in the website Pravda trumpeted President Vladimir V. Putin’s latest coup, its nationalistic fervor recalling an era when its precursor served as the official mouthpiece of the Kremlin: “Russian Nuclear Energy Conquers the World.”

The article, in January 2013, detailed how the Russian atomic energy agency, Rosatom, had taken over a Canadian company with uranium-mining stakes stretching from Central Asia to the American West. The deal made Rosatom one of the world’s largest uranium producers and brought Mr. Putin closer to his goal of controlling much of the global uranium supply chain.

But the untold story behind that story is one that involves not just the Russian president, but also a former American president and a woman who would like to be the next one.

At the heart of the tale are several men, leaders of the Canadian mining industry, who have been major donors to the charitable endeavors of former President Bill Clinton and his family. Members of that group built, financed and eventually sold off to the Russians a company that would become known as Uranium One.

Beyond mines in Kazakhstan that are among the most lucrative in the world, the sale gave the Russians control of one-fifth of all uranium production capacity in the United States. Since uranium is considered a strategic asset, with implications for national security, the deal had to be approved by a committee composed of representatives from a number of United States government agencies. Among the agencies that eventually signed off was the State Department, then headed by Mr. Clinton’s wife, Hillary Rodham Clinton.

As the Russians gradually assumed control of Uranium One in three separate transactions from 2009 to 2013, Canadian records show, a flow of cash made its way to the Clinton Foundation. Uranium One’s chairman used his family foundation to make four donations totaling $2.35 million. Those contributions were not publicly disclosed by the Clintons, despite an agreement Mrs. Clinton had struck with the Obama White House to publicly identify all donors. Other people with ties to the company made donations as well.

And shortly after the Russians announced their intention to acquire a majority stake in Uranium One, Mr. Clinton received $500,000 for a Moscow speech from a Russian investment bank with links to the Kremlin that was promoting Uranium One stock.

That’s what Hillary Clinton did as Secretary of State. I wonder if Democrat voters are paying attention. I wonder if national security is important to them.

Iraq:

[…][W]hen the [Iraq] war was at a tipping point in 2007 and General David Petraeus advocated for a surge of U.S. forces to regain lost momentum, she voted against it.

As secretary of state she failed to negotiate a residual force that would have prevented Prime Minister Nouri al-Maliki from creating sectarian strife. The ensuing strife led to the creation of an irregular war between Sunni and Shia with the Islamic State growing from that turmoil.

Libya:

Clinton considers the 2011 overthrow of Moammar Gadhafi in Libya to be one of her finest hours as secretary of state. President Obama considers it one of his worst failures. As secretary of state, she pushed for U.S. and NATO involvement against Gaddafi. When he was overthrown, there was no plan for follow-up governance. The result was instability, a huge refugee flow into southern Europe and the Islamic State gaining a foothold in Libya.

Worse was the eventual loss of U.S. Ambassador Christopher Stevens in the Benghazi terrorist attack. It was the first killing of a U.S. ambassador in the line of duty since 1979. The response from our secretary of state? She claimed his killing was the result of an anti-Islamic video.

Russia:

As secretary of state she proudly pushed the “reset” button on U.S.-Russia relations with Russian Foreign Minister Sergey Lavrov in 2009. She couldn’t even get the translation on the button correct: The Russian word emblazoned on the button actually meant “overload.”

How prescient. The ensuing result was Cold War 2.0. After her reset, Russia took Crimea, invaded Ukraine, strongly supported Syrian President Bashar Assad, conducted airstrikes against civilians in Aleppo, Syria and significantly increased their military and political presence in the Middle East.

Syria:

In Syria, while secretary of state, Clinton watched as United Nations resolution after U.N. resolution failed. She accomplished nothing except to repeat the refrain “Assad must go.” She said in 2012 that opposition to Assad was the first step towards a better future for the people of Syria.

Tell that to the 500,000 Syrian dead or the 3 million refugees. When Obama drew a red line in 2012 against chemical weapons-use against civilians, Clinton stood by and did nothing as the Syrian regime used sarin nerve gas against civilians.

Egypt:

In 2009, Clinton called Egyptian President Hosni Mubarak and his wife “friends of the family.” Some friends. In January of 2011 they were gone, overthrown by an Arab Spring uprising Clinton openly supported. Even greater turmoil followed under the Muslim Brotherhood until a popular uprising resulted in their overthrow.

The new, popularly-elected President Abdel el-Sisi is considered by Clinton to be governing through what is “basically an army dictatorship.” Egypt has always been critical to the stability of the Middle East pertaining to Israel. We need them with us for continued efforts to maintain peace in the region. Clinton’s position denigrates a key ally in the Middle East.

The article does not mention the disastrous Iran deal, which gave Iran $1.7 billion to help them fund terrorist attacks and develop nuclear weapons for use against Israel. But Hillary Clinton supported that deal, too – according to the far left New York Times.

This article by Victor Davis Hanson in National Review recalls her lack of concern for national security:

Had anyone else in government set up a private e-mail server, sent and received classified information on it, deleted over 30,000 e-mails, ordered subordinates to circumvent court and congressional orders to produce documents, and serially and publicly lied to the American people about the scandal, that person would surely be in jail. The Clinton Foundation is like no other president-sponsored nonprofit enterprise in recent memory — offering a clearing house for Clinton-family jet travel and sinecures for Clintonite operatives between Clinton elections. Hillary Clinton allotted chunks of her time as secretary of state to the largest Clinton Foundation donors. Almost every assistant whom she has suborned has taken the Fifth Amendment, in Lois Lerner fashion.

Being “present” when decisions were made doesn’t give someone a resume that is worth offering them a job. What matters is that they were present and made the right decisions. Hillary Clinton has no accomplishments. Unless you are one of America’s enemies, there is no reason to expect her to be a good President. We know this from her record of failure. She just doesn’t have the ability and the skill needed to exercise good judgment on foreign policy and national security.

Here is a story that is sure to set back the Hillary Clinton campaign. (H/T Dad)

The Wall Street Journal reports:

The political organization of Virginia Gov. Terry McAuliffe, an influential Democrat with longstanding ties to Bill and Hillary Clinton, gave nearly $500,000 to the election campaign of the wife of an official at the Federal Bureau of Investigation who later helped oversee the investigation into Mrs. Clinton’s email use.

Campaign finance records show Mr. McAuliffe’s political-action committee donated $467,500 to the 2015 state Senate campaign of Dr. Jill McCabe, who is married to Andrew McCabe, now the deputy director of the FBI.

The Virginia Democratic Party, over which Mr. McAuliffe exerts considerable control, donated an additional $207,788 worth of support to Dr. McCabe’s campaign in the form of mailers, according to the records. That adds up to slightly more than $675,000 to her candidacy from entities either directly under Mr. McAuliffe’s control or strongly influenced by him. The figure represents more than a third of all the campaign funds Dr. McCabe raised in the effort.

Mr. McAuliffe and other state party leaders recruited Dr. McCabe to run, according to party officials. She lost the election to incumbent Republican Dick Black.

[…]Among political candidates that year, Dr. McCabe was the third-largest recipient of funds from Common Good VA, the governor’s PAC, according to campaign finance records.

[…]Mr. McAuliffe has been a central figure in the Clintons’ political careers for decades. In the 1990s, he was Bill Clinton’s chief fundraiser and he remains one of the couple’s closest allies and public boosters. Mrs. Clinton appeared with him in northern Virginia in 2015 as he sought to increase the number of Democrats in the state legislature.

Dr. McCabe announced her candidacy in March 2015, the same month it was revealed that Mrs. Clinton had used a private server as secretary of state to send and receive government emails, a disclosure that prompted the FBI investigation.

Do you ever wonder why the FBI declined to prosecute Clinton, even though less connected people were prosecuted and convicted for the same crimes? Maybe because this McCabe guy was very high up in the agency:

At the time the investigation was launched in July 2015, Mr. McCabe was running the FBI’s Washington, D.C., field office, which provided personnel and resources to the Clinton email probe.

That investigation examined whether Mrs. Clinton’s use of private email may have compromised national security by transmitting classified information in an insecure system. A review of Mrs. Clinton’s emails concluded that 110 messages contained classified information. Mrs. Clinton has said she made a mistake but that she never sent or received messages that were marked classified.

At the end of July 2015, Mr. McCabe was promoted to FBI headquarters and assumed the No. 3 position at the agency. In February 2016, he became FBI Director James Comey’s second-in-command.

As deputy director, Mr. McCabe was part of the executive leadership team overseeing the Clinton email investigation…

Naturally, the article contains lots of denials and disclaimers from the Clinton camp. Readers will have to make up their minds for themselves.

The congressional leader of a key House committee governing the use of technology announced on Thursday that Congress is taking unprecedented action to hold in contempt a computer company that supplied former Secretary of State Hillary Clinton with her private email server, which was since found to contain classified information in violation of federal protocol.

Rep. Lamar Smith (R., Texas), chair of the House Science, Space, and Technology Committee, informed reporters that he is moving forward with procedures to hold in contempt Platte River Networks, a security firm that helped maintain Clinton’s private servers.

Smith announced that he is in possession of emails that show Clinton’s lawyer instructed companies involved with the server to thwart an official investigation by Congress.

Platte River has “obstructed” investigations by Congress and failed to produce critical documents about the server’s security vulnerabilities, according to Smith, who accused the firm of stonewalling Congress for months.

[…]“After many weeks, months, we realized we were being stonewalled, we were not being given information,” Smith told reporters on Capitol Hill. Platte River “continues to obstruct” the congressional probe into the “possible misuse” of Clinton’s server, he said.

“We do not take issuing a subpoena lightly, nor do we take holding someone in contempt lightly,” Smith said. “Platte River continues to refuse to comply at the direction of Secretary Clinton. Regrettably, former Secretary Clinton has interfered with the committee’s investigation.”

Now might be a good time to review some of Hillary Clinton’s big lies.

The Washington Times has a good list:

Many of us remember the classic line from the “Seinfeld” show, that “it’s not a lie if you believe it.” Applying that theme to the evolution of Hillary Rodham, then Hillary Rodham Clinton, and now just plain Hillary Clinton, here are the notable accomplishments of her “public service” career:

• Flunked the D.C. Bar Exam.

• Was removed from her House Judiciary Committee staffer job because of incompetence and lying.

• The Whitewater scandal.

• Married a serial liar and cheater, who occasionally had sexual encounters with nonconsenting partners.

• Lied about “sniper fire” in an attempt to simulate exposure to danger in a war zone.

• The subject of a “vast right-wing conspiracy” that led to the impeachment and disbarment of her husband

• Took crockery, furniture, artwork and other items from the White House — had to return and/or pay for them.

• Said “what difference, at this point, does it make” about four brave people killed in Libya as a direct result of her failure to protect them on the anniversary of 9/11.

• Totally ignored the structure and rules for the handling of sensitive national security information.

• Amassed a personal fortune with “speaking fees” and payments from private sector political donors and foreign governments into transparent “foundations” in obvious exchange for future political favor.

The one in bold is my favorite.

Investigative reporter Sharyl Attkisson reminds us the secretary of state who blamed Benghazi on a video once made up a story about courage under fire in Bosnia.

[…]Former CBS reporter Sharyl Attkisson reminded the world of Hillary’s tale of heroism in an interview with CBS Philadelphia affiliate WPHT morning host Chris Stigall last November, a tale told by the former first lady in her 2008 run against one Barack Obama.

“I had come home from an overseas trip vacation, and my husband says, ‘When you went to Bosnia 12 years ago with the first lady, were you shot at?,’ and I’m like, ‘No, I think I would know if I were shot at,’” Attkisson told Stigall of the 1996 trip to Bosnia with Hillary, first daughter Chelsea and celebrities Sinbad and Sheryl Crow.

Candidate Clinton claimed in a 2008 speech in Washington and several subsequent interviews that she and Chelsea were forced to run for cover under hostile fire shortly after landing in Tuzla, Bosnia.

“I remember landing under sniper fire,” Clinton said. “There was supposed to be some kind of greeting ceremony at the airport, but instead we just ran with our heads down to get into the vehicles to get to our base.”

Her harrowing tale never happened, and Mrs. Clinton’s faulty memory also forgot that there was a reporter on the trip who was taking notes and had a video of the event.

“The video showed,” Attkisson said, “and I thought this was a pretty good way to explain it — I put her in a box saying, ‘We got off the plane and had to duck and run for cover and there was sniper fire’ and then I show the video of what was really happening, and she’s getting off the plane and she’s waving, shaking hands with a little school girl.”

Here’s the video:

It shows that her essential character is like Walter Mitty – always imagining herself to be more heroic than she is. Thing is, Walter Mitty just day dreamed. Hillary tries to actually lie about it in public. Most of us outgrow this tendency to exaggerate in order to appear more important in our teens. Hillary never did.
