Supreme Court narrowly sides with private schools against government

The Supreme Court’s big school choice decision yesterday is notable mainly for its insight into the progressive mind. To wit, no fewer than four Justices seem to believe that all wealth belongs to the government, and then government allows citizens to keep some of it by declining to tax it.

At issue in Arizona Christian School Tuition Organization v. Winn was a state tax credit for donations to organizations that offer scholarships for private schools, including (but not exclusively) religious schools. A group of taxpayers sued, claiming that religion was being subsidized on their dime, in violation of the First Amendment’s establishment clause.

The district court tossed out this novel church-state theory, only to have it revived by the Ninth Circuit Court of Appeals. Yesterday’s 5-4 decision was another well-deserved rebuke to the nation’s leading judicial activists who dominate that appellate court.

[…]And what do you know, four Justices assume precisely that. Both of President Obama’s nominees joined the four dissenters, and newcomer Elena Kagan delivered a fiery 24-page apologia for that position, claiming that “the distinction” between appropriations and tax credits “is one in search of a difference.” There’s a good debate to be had about tax credits (see below), but one question for Justice Kagan: Is the government also establishing religion by not imposing a 100% tax rate on churches, mosques and synagogues?With one more vote, the current Court’s liberal minority would surely ban school choice involving any religious schools. The Arizona decision shows again that the Court is only a single vote away from many decisions not all that far removed from those of the Ninth Circuit.

Note that Obama’s two new appointees sided against Christian schools and private schools. Yet some brain-damaged Christians actually vote for Democrats, and claim to be Christians. (And they claim to want to get married and to raise children who will presumably be Christians, too!). School choice is as central an issue to informed Christians as is opposition to no-fault divorce, same-sex marriage and abortion.

Apple is OK with Grindr gay hook-up app, but not OK with Gay Cure app

Apple removed Exodus International’s app after critics released a position calling the organization “hateful and bigoted.” Exodus promotes “freedom from homosexuality through the power of Jesus Christ.”

[…]Apple spokesman Tom Neumayr told CNET that Apple pulled the app because “it violates our developer guidelines by being offensive to large groups of people.”

[…]About 147,000 people have signed a petition addressed to Apple CEO Steve Jobs that stated: “Apple doesn’t allow racist or anti-Semitic apps in its app store, yet it gives the green light to an app targeting vulnerable LGBT youth with the message that their sexual orientation is a ‘sin that will make your heart sick’ and a ‘counterfeit’. This is a double standard that has the potential for devastating consequences.”

[…]Other organizations and companies have been targeted because of issues related to sexuality. Equality Matters has targeted Chick-Fil-A for being connected to other ministries. “In fact, the company has strong, deep ties to anti-gay organizations like Focus on the Family and the Fellowship of Christian Athletes, and its charitable division has provided more than $1.1 million to organizations that deliver anti-LGBT messages and promote egregious practices like reparative therapy that seek to ‘free’ people of being gay.”

Lady Gaga ended a deal with Target for exclusively selling a version of her new album, saying the corporation supported anti-gay rights groups.

Apple made a similar decision last year when it removed an app from the Manhattan Declaration. After a petition with about 7,000 signatures, Change.org, Apple removed it from the app store.

Applications that suggest that people might be able to leave the gay lifestyle should be banned, according to some gay activists. They don’t like traditional views of sex, and they are prepared to force their views onto others who merely disagree with them. They call that “tolerance”.

But some apps are OK for Apple and gay activists – like Grindr.

Alex Cohen is on a date – sort of. He’s having Thai food in the Castro with his new friend Sean, whom he met through his iPhone, all the while texting nine other guys whom he might hook up with later.

Not that Sean is offended. Between bites of fried calamari, he’s texting a handful of other men who might become his Mr. Right for the night.

They are “grinding,” the latest verb in the gay lexicon, which refers to the new gay dating app for the iPhone called Grindr. A revolutionary way to meet gay men, Grindr has eliminated the need for “gay-dar”; it uses GPS technology to download hundreds of pictures of available men within walking distance.

Alex and Sean can click on a man’s picture to start a text conversation, send pictures and, if they so desire, make arrangements for a rendezvous. There’s a number on each man’s photo, indicating how many feet away they are at that instant.

Apple thinks that Grindr is just fine. Apple thinks that anonymous sex is just fine. But Apple doesn’t think that free speech is just fine.

If you like free speech, then don’t buy Apple products. I like free speech, so I don’t buy Apple products.

UK judge rules that Christians have no right to religious liberty

Lord Justice Munby and Mr Justice Beatson made the remarks when ruling on the case of a Christian couple who were told that they could not be foster carers because of their view that homosexuality is wrong.

The judges underlined that, in the case of fostering arrangements at least, the right of homosexuals to equality “should take precedence” over the right of Christians to manifest their beliefs and moral values.

In a ruling with potentially wide-ranging implications, the judges said Britain was a “largely secular”, multi-cultural country in which the laws of the realm “do not include Christianity”.

[…]The ruling in the case of Owen and Eunice Johns, from Derby, is the latest in a series of judgments in which Christians have been defeated in the courts for breaching equality laws by manifesting their beliefs on homosexuality.

[…]In their ruling yesterday, the judges complained that it was not yet “well understood” that British society was largely secular and that the law has no place for Christianity.

“Although historically this country is part of the Christian West, and although it has an established church which is Christian, there have been enormous changes in the social and religious life of our country over the last century,” they said.

It was a “paradox” that society has become simultaneously both increasingly secular and increasingly diverse in religious affiliation, they said.

“We sit as secular judges serving a multicultural community of many faiths. We are sworn (we quote the judicial oath) to ‘do right to all manner of people after the laws and usages of this realm, without fear or favour, affection or ill will’.”

The judges acknowledged that there was a “tension” in the case of Mr and Mrs Johns between the rights of individuals to maintain their religious beliefs and the rights of homosexual people to live free from discrimination.

However, when fostering regulations were taken into account, “the equality provisions concerning sexual orientation should take precedence” over religious rights, they said.

The world becomes a more evil place when Christians are forced to retreat into the shadows by the fascist state. I wonder if the two defendants voted for the Labor government that brought in these anti-Christian changes? I hope that they did not vote for the Labor Party, because it is a fearful thing to be your own executioner.
