Gay federal judge rules traditional marriage unconstitutional in California

A federal judge has ruled that California’s constitutional amendment defining marriage as the union of a man and a woman is unconstitutional, because it excludes same-sex unions.

Chief Judge Vaughn Walker, who presides over the U.S. District Court for the Northern District of California, declared Proposition 8 had no “rational basis” in a 138-page ruling on the Perry v. Schwarzenegger case released Wednesday afternoon.

[…]The judge dismissed the amendment, saying its restriction of marriage to heterosexual couples was “nothing more than an artifact of a foregone notion that men and women fulfill different roles in civic life.” He also added that it seemed to him proponents of Prop. 8 were defending the amendment on the basis of “moral disapproval,” which he said was “an improper basis on which to deny rights to gay men and lesbians” and enacted in law, “a private moral view that same-sex couples are inferior to opposite-sex couples.”

[…]Walker, however, is himself an active homosexual, and some conservative critics of the Prop. 8 case contended that Walker would be too personally invested in the case to deliver an impartial outcome.

[…]Walker also ruled that domestic partnerships did not satisfy the duty on California to let same-sex couples marry each other.

In court papers filed Tuesday night, lawyers for the Proposition 8 defense team asked Chief U.S. District Judge Vaughn Walker for a stay of his ruling if the outcome is to declare the law unconstitutional. The motion indicates that the Proposition 8 lawyers will immediately ask the 9th U.S. Circuit Court of Appeals to review the ruling if Walker rules against them.

The Obama administration has credited its $862 billion stimulus program with pulling the economy out of the worst recession since the Great Depression. But a new report by two Republican senators argues the stimulus is riddled with wasteful projects that do not create jobs.

The report, released by Sens. Tom Coburn, R-Okla., and John McCain, R-Ariz., highlights 100 stimulus projects that they say have “questionable goals,” are “being mismanaged or were poorly planned” and are even “costing jobs and hurting small businesses.”

The Coburn-McCain report takes issue with stimulus spending on projects like one that entailed research on how cocaine affects monkeys. The Wake Forest University Baptist Medical Center was awarded $71,623 to study what the report calls, “Monkeys Getting High for Science.”

Bonnie Davis, a spokeswoman for The Wake Forest University Baptist Medical Center, said the “small grant has helped protect very important research that will have significant impact on public health in regards to cocaine addiction and the issue of relapse.”

Go a little further down the list and you’ll find even bigger spending. The California Academy of Sciences is receiving nearly $1 million in stimulus funds to send researchers to the Southwest Indian Ocean Islands and East Africa to capture, photograph and analyze thousands of exotic ants.

There’s also funding for yoga and hot flashes. Researchers at Wake Forest University have received nearly $300,000 to study whether integral yoga “can be an effective method to reduce the frequency and/or severity of hot flashes” in breast cancer survivors.

This is what happens when you take money away from investors and businesses and give it to government bureaucrats to spend. Unemployment doubles compared to what it was under George W. Bush. Because money was taken from the people who create jobs and spend by people who have no experience in the private sector and no knowledge of economics.

Suspect in massive leak of military secrets is a gay rights activist

Bradley Manning, the prime suspect in the leaking of the Afghan war files, raged against his US Army employers and “society at large” on his Facebook page in the days before he allegedly downloaded thousands of secret memos, The Daily Telegraph has learnt.

The US Army intelligence analyst, who is half British and went to school in Wales, appeared to sink into depression after a relationship break-up, saying he didn’t “have anything left” and was “beyond frustrated”.

In an apparent swipe at the army, he also wrote: “Bradley Manning is not a piece of equipment,” and quoted a joke about “military intelligence” being an oxymoron.

Mr Manning, 22, who is currently awaiting court martial, is suspected of leaking more than 90,000 secret military documents to the Wikileaks website in a security breach which US officials claim has endangered the lives of serving soldiers and Afghan informers.

[…]Mr Manning, who is openly homosexual, began his gloomy postings on January 12, saying: “Bradley Manning didn’t want this fight. Too much to lose, too fast.”

[…]Pictures on Mr Manning’s Facebook page include photos of him on school trips during his time in Wales and at a gay rights rally, where he is holding up a placard demanding equality on “the battlefield”.
