Court says nurse who was forced to perform late-term abortion can’t sue

Today the Second Circuit Court of Appeals ruled that a Catholic nurse who was forced by a New York hospital to participate in an abortion does not have the right to sue her employer.

Administrators at Mt. Sinai Hospital had threatened Catherine DeCarlo with disciplinary measures in May 2009 if she did not honor a last-minute summons to assist in a scheduled late-term abortion. The hospital insisted on her participation in the procedure on the grounds that it was an “emergency.”

Lawyers for DeCarlo, however, have pointed out that the procedure was not classified by the hospital as an emergency, and the patient was apparently not in crisis at the time of the surgery.

DeCarlo claims that her participation in the abortion led to serious emotional trauma. She also claims that hospital administrators later attempted to coerce her into signing an agreement to participate in abortions in the future.

The hospital had reportedly known of the Catholic nurse’s religious objections to abortion since 2004.

Alliance Defence Fund (ADF) attorneys had filed two suits in the case – one federal, filed in July 2009, and another state, filed earlier this year. The federal suit claimed that Mt. Sinai ignored federal laws prohibiting coercion while receiving hundred of millions of dollars in federal funding.

In January the case was dismissed by the United States District Court for the Eastern District of New York, at which point it was appealed to the Second Circuit.

However, in today’s ruling the court found that there is no right to private action or private remedy under the statue cited by DeCarlo in her suit – the so-called “Church Amendment.”  (Read the decision here.)

That amendment protects health care workers working for federally-funded entities from being discriminated against because they refused to perform abortions on religious or conscience grounds.

In other news, pro-abortion nutter attacks pro-life display with metal pipe and gets arrested when he turns to attack pro-lifers, too. Hey – anti-life is pro-violence. That’s their view.

How China coerces sterilization and sells the organs of prisoners

Doctors in southern China are working around the clock to fulfil a government goal to sterilise — by force if necessary — almost 10,000 men and women who have violated birth control policies. Family planning authorities are so determined to stop couples from producing more children than the regulations allow that they are detaining the relatives of those who resist. About 1,300 people are being held in cramped conditions in towns across Puning county, in Guangdong Province, as officials try to put pressure on couples who have illegal children to come forward for sterilisation.

In a news conference on Capitol Hill, several speakers, including attorney David Matas of B’nai Brith Canada and Ethan Gutmann of the Foundation for the Defense of Democracies, said their investigations have unearthed a grisly trade in which an estimated 9,000 members of Falun Gong have been executed for their corneas, lungs, livers, kidneys and skins.

They likened the practice to the Nazi treatment of Jewish prisoners in World War II concentration camps, which included using them for sadistic medical experiments and taking the gold fillings from the teeth of corpses. The newest wrinkle, they said, is that organs from other religious prisoners — specifically dissidents from China’s Christian, Muslim and Tibetan Buddhist communities — are also being harvested to satisfy an insatiable global demand.

This is a tough dilemma for me. On the one hand, I value free trade, and free trade is what gives us leverage to raise these human rights abuses with China – because they need our purchases. On the other hand, how can we have any kind of relationship with a country like this? It’s too bad that human rights groups like Amnesty International are so radically on the left. Instead of spending their time bashing the USA for waterboarding terrorists, they should be looking into actual crimes.

Environmentalists support restrictions on number of children per family

At the event, Revkin said: “Well, some of the people have recently proposed: Well, should there be carbon credits for a family planning program in Africa let’s say? Should that be monetized as a part of something that, you know, if you, if you can measurably somehow divert fertility rate, say toward an accelerating decline in a place with a high fertility rate, shouldn’t there be a carbon value to that?

“And I have even proposed recently, I can’t remember if it’s in the blog, but just think about this: Should–probably the single-most concrete and substantive thing an American, young American, could do to lower our carbon footprint is not turning off the lights or driving a Prius, it’s having fewer kids, having fewer children,” said Revkin.

“So should there be, eventually you get, should you get credit–If we’re going to become carbon-centric–for having a one-child family when you could have had two or three,” said Revkin. “And obviously it’s just a thought experiment, but it raises some interesting questions about all this.”

The worst thing that you or I can do for the planet is to have children. If they behave as the average person in the rich world does now, they will emit some 11 tonnes of CO² every year of their lives. In their turn, they are likely to have more carbon-emitting children who will make an even bigger mess…

In 2050, 95% of the extra population will be poor and the poorer you are, the less carbon you emit. By today’s standards, a cull of Australians or Americans would be at least 60 times as productive as one of Bangladeshis… As Rachel Baird, who works on climate change for Christian Aid, says: “Often in the countries where the birth rate is highest, emissions are so low that they are not even measurable. Look at Burkina Faso.” So why ask them to pay in unborn children for our profligacy..?

But how do you reduce population in countries where women’s rights are already achieved and birth-control methods are freely available? Could children perhaps become part of an adult’s personal carbon allowance? Could you offer rewards: have one child only and you may fly to Florida once a year?

After all, based on current emissions and life expectancy, one less British child would permit some 30 women in sub-Saharan Africa to have a baby and still leave the planet a cleaner place.

A lot of people ask why I am so concerned about getting married in a nation in which 77% of young, unmarried women voted for Obama and his radically leftist science czar and radically leftist former green jobs czar. (The science czar favored mass sterilizations and forced abortions). And now we can see part of the answer: the left wants to interfere with my reproductive freedom using state coercion.

And it’s not just environmental reporters who are against people having children. It’s Obama’s own nominees. These fears of overpopulation are like “Left Behind” novels for the secular left. The failed doomsday predictions of Paul Ehrlich are identical to the failed doomsday predictions of Jehovah’s Witnesses. There is something very strange about these people – and women should not have voted for them.

Recall that Social Security and other government programs are fueled by income taxes on younger workers. Except that the overpopulation nutters aborted the next generation of American workers. Ooops. So where are we supposed to get the money for these ballooning social programs from if the left keeps putting restrictions on pregnancy?
