Judge: man must pay support to girlfriend despite living in separate homes

A friend of mine was asking me last night whether I had any regrets about never marrying, especially since I had such awesome Christian female friends like her. I thought about it, and I thought that maybe it is better to not have married, especially when I read stories about how family courts trample over the rights of men to favor women, regardless of what the law says.

The story is from one of Canada’s national newspapers, the National Post:

A wealthy businessman will have to pay more than $50,000 a month in spousal support for 10 years to a woman with whom he had a long-term romantic relationship even though they kept separate homes and had no children together, Ontario’s top court has ruled.

Under Ontario law, an unmarried couple are considered common-law spouses if they have cohabited — lived together in a conjugal relationship — continuously for at least three years. But that doesn’t necessarily mean living in the same home, the court found.

[…]When their 14-year relationship finally broke down in May 2015, Climans asked the courts to recognize her as Latner’s spouse and order him to pay her support. He argued she had been a travel companion and girlfriend, nothing more. As such, he said, they were never legally spouses and he owed no support. An eight-day trial ensued.

In her decision in February 2019, Superior Court Justice Sharon Shore sided with Climans. She ruled they were in fact long-time spouses, finding that despite their separate home, they lived under one roof at Latner’s cottage for part of the summer, and during winter vacations in Florida. Shore ordered him to pay her $53,077 monthly indefinitely.

The judge ordered him to pay her $53,077 per moth, indefinitely. Elsewhere in the article, we learn that he had asked her to sign a pre-nuptial agreement many times, and each time she refused. (Those are not even enforced fairly by the way) She wanted his money, and the judge made sure she got it. Because the law doesn’t matter in a family court.

So, what I wanted to point out about this is the fact that a female judge decided to bend the law in order to favor a woman. And this sort of thing happens A LOT in Canada – where their female judges are notorious for progressive judicial activism, e.g. Beverley Mclachlin, Bertha Wilson, Claire L’Heureux-Dubé, etc. Ontario family courts are notoriously anti-male, and men know this.

But it’s not just Ontario. I have two Christian friends who married their Christian wives as virgins, and then their wives divorced them. I heard what happened to them in divorce court. Again, female lawyers and female judges disregarded the law in order to punish the man and favor the woman. And I think most men growing up today have a father or a brother or an uncle or someone who has been a victim of this.

When I talk to women about this, they all say things like this to me: “oh, you worry too much” or “you read too many books about divorce” or especially “when you meet the right girl, you’ll fall in love, and all this concern about atheistic feminist judges in the courts won’t stop you”. That last one is the most popular. And it’s always made me think that if this is how women see commitment – feelings-based – it’s no wonder that women initiate 70% of divorces.

I always thought it was a curse that I grew up poor and could not afford to show off my wealth in order to attract attention from women. Now I see that God actually gave me a great blessing. In order for a man to get married, it takes a lot more than finding the right girl. He needs to live in the right culture – a culture that tries to equip women to be content in committed relationships and treat men fairly.

I don’t think even women who claim to be pro-male and/or pro-marriage know or care how stories like this affect men. I’m very wealthy. I certainly do look at what is likely to happen if a woman goes to the courts expecting me to give her money. In fact, whenever I post stories on my wall about how the judges legislate from the bench to transfer money from men to women, there’s just silence or sometimes deflection by attacking men (except for my friend Dina who agrees with me). No one dares to speak up for men, it’s just expected that we be robbed by the government in order to make women happy. Because “marriage is for women”.

And as long as the message keeps being sent by judicial activists in the family courts, men will keep adjusting how they treat women. Women appear very unsafe to us, and nothing that’s going on in the courts is changing the trend towards avoidance. Men are very good at calculating risks vs rewards.

Children of divorce are in desperate need of a relationship with both their parents. Sadly, far too many are reduced to having a relationship with only one parent: the mother.

Citing a principle called the “best interest of the child,” family courts award sole or primary custody of most children of divorced parents to mothers, thereby reducing fathers to occasional visitation and zero authority.

The silence on this issue is deafening, and this silence comes just as much from the right as it does from the left. It even comes from churches.

For a virgin who has not and probably never will marry, I have had a lifelong interest in how to date and marry the right way – in order to get results and leave a legacy. So I know all these speakers, and have books my many of them (Dr. Laura, Janice Fiamengo, Helen Smith, Dr. Laura, Christina Hoff Sommers, Stephen Baskerville, etc.) in my house. I’m fascinated by these issues and know very much about what does and does not work in a marriage.

More and more women are asking why they can’t find a good man to marry

In the last few months, I’ve met 5 different Christian women in their 30s who all asked me the same question: where are all the good men who want to marry me?

Christian men’s rights blogger Dalrock had two different posts where he described the answer to this question.

Here is the first post from Dalrock that concisely illustrates the problem:

As I wrote in A very long season, feminists don’t want to waste a day more of their youth and fertility on their husbands than absolutely necessary. As if to prove this very point, 30 year old Mona Chalabi writes in the NY Times* I Want My 2.3 Bonus Years:

If I could prolong my time as a young adult by, say, 2.3 years, here is a list of things I would like to do:

• Go to more parties. Preferably wild parties that I can think about, years later, at mild parties.

[…]• Have more romantic partners.

[…]• Get a bit higher up the career ladder a bit earlier on. That would probably boost my earnings, giving me more financial security. I could use that money to go to more parties, get a membership to a fancy gym and maybe even meet a romantic partner on the ab machines.

To drive the message home, the image at the top of the article is a cartoon of a resentful Chalabi giving her future husband the side eye for her lost years of sampling penises!

Surely, this must be an isolated case just for New York Times feminists, right? It’s not widespread, is it?

Second post from Dalrock:

Margaret Wente at the Globe and Mail* asks where all the good men have gone.  Wente comes to the conclusion that women need a sex cartel:

…it’s up to us to make the rules. “Why buy the cow when you can get the milk for free?” my father used to say. It drove me crazy when he said that. Now, it’s dawned on me that he was right.

Since the women’s cartel collapsed, women’s bargaining power has seriously eroded. That’s why so many single women hate Tinder, which has further commodified sex for the benefit of men. Women are just another consumer good in the shop window.

The apex fallacy aside, Wente is partially right.  Women (as a group) have signaled to men that what they really want are exciting sexy badboys, not boring loyal dudes. It isn’t that women no longer want to marry beta providers, they just don’t want to waste a day more of their youth and fertility on their husband than absolutely necessary.

As a result, some up and coming boring loyal dudes aren’t knocking themselves out in their twenties while they wait for their future wife to tire of having sex with other men.

If you wonder why men are no longer performing in school, and exchanging careers for video games, the answer is simple. Men have realized that young women today, under the influence of feminism, are not interested in traditional husbands during their late teens and 20s. During these years, women are interested in travel, fun, drinking, hook-ups and cohabitation with amoral atheists. This is what I have personally observed. In the minds of young women, the highest value men are good-looking men who have no religion, and make no moral judgments, and are left of center politically – especially on abortion.

There are actually many other men who don’t meet this standard – marriage-minded men – who want to get married young and have children. But when these men see what young women really want, they just give up on school and work, since doing the traditional male roles has no value to young women. Many good men even give up on morality and Christianity, because they want a relationship with a woman so badly. They know that women don’t want marriage-minded men when women are youngest and prettiest.

What Wente doesn’t understand is that timing is everything.  From an economic point of view, women are dividing up sexual access that traditionally would have been reserved only for their husband into two blocks.  The first block contains their most attractive and fertile years, and it is dedicated to no strings sex with exciting badboys.  Then, once women reach what Rollo calls the epiphany phase, they want to bargain sexual access in their remaining (older and less fertile) years for maximum beta bucks.

The problem with this strategy is (generally speaking) not that the previously overlooked beta men will refuse to marry the suddenly reformed party girls.  The problem is that young men now look at the men 3-5 (and even 5-10) years older than them and don’t see an indication that signaling provider status will make them attractive to women.  They also see a society that holds married fathers in contempt**.  Most of these men are still working hard in their late teens and twenties to prepare to signal provider status in their 30s.  But a growing minority of young men are no longer doing so.  These men are instead working like women.  Once the reformed party girls are ready to find Mr. Beta Bucks, there is a shortage of 30 something men who fit the bill.  Even worse, no amount of complaining or shaming will cause the missing beta providers to go back in time and spend the prior decade preparing for this moment.

I’m one of the last men who followed the marriage-preparedness script for traditional men who wanted to marry and have four children and have a stay-at-home homeschooling mom to raise them from birth to graduate school. I find myself now in my mid-40s, with a 6-figure income and a 7-figure net worth. I never used my success to play the field with hot bad girls. I wanted to keep my sexual past completely clean for my eventual wife. However, what I observed in my late teens and 20s and even early 30s was a complete lack of interest in marriage ability, from non-Christian women and Christian women alike. Christian women aren’t learning to value early marriage from their married parents or their evangelical churches. None of the traditional husband skills are valued by young women, i.e. – chastity, gapless resume, alcohol abstinence, undergraduate and graduate STEM degrees, experience nurturing and mentoring others, stewardship of earned income.

I recently caused an uproar on my Facebook page by saying that even if the perfect woman showed up right now to marry me, I would not pursue her because the critical time where the woman could have applied maximum youth, beauty and fertility as a wife to make an impact on my education, early career, health, and finances has passed. A younger woman develops value to her husband precisely by applying herself to him and to her family in these critical early years. Men who have experienced this self-sacrificial love and support are loyal to their wives even after their wives lose their youth and beauty. Why? Because the men know that they are much better than they could have been, having enjoyed that early investment of value made by their young wives.

As Christian writer Matt Walsh notes in a recent article at the Daily Wire, this “follow your heart” focus on happiness in women is lethal to marital stability, and men know it.

Excerpt:

There was an article in Cosmo this week with a title that summarizes all that’s wrong with Cosmo and modern society as a whole: “I eloped at 25, divorced at 26, and dated my way across Europe all summer.” Of course, by “dated my way across Europe” she means that she slept with half the continent.

The author, Elise, says she “started fighting” with her husband and within a few months they both decided that their differences were irreconcilable. Despite counseling, she says, “neither of us was happy.” So, exhausted from 12 whole months of marriage, Elise embarked on a voyage of self-discovery and STD cultivation. She met random dudes in half a dozen countries and had sex with them, learning quite a lot as she went, though she can’t really explain what exactly she learned or why sex was a necessary component in learning it. Finally, she came home and started dating some other guy. The end.

Well, not really the end. 20 years from now I’m sure we’ll get the follow up article: “I’m alone and miserable and it’s everyone’s fault but mine.” After all, you may be able to fill the emptiness in your soul with frivolous sex when you’re young and physically desirable, but that phase is fleeting. People who don’t want to “waste” their beauty and youth on a spouse, so they waste it instead on strangers who don’t love them or even care what happens to them tomorrow, will be shocked when a tomorrow comes where even strangers aren’t interested anymore. This is where the single-minded, utterly selfish pursuit of “happiness” at all costs inevitably leads: to rejection, despair, and a quiet, unnoticed death on a lonely hospital bed.

As Elise helpfully demonstrated, “do what makes you happy” is poison in a marriage. Many a vow has been broken because one or both partners decide to chase “happiness” instead of commitment, fidelity, and love. “I deserve to be happy,” reports the legion of serial divorcees, as they drift on to the next spouse, and the next, and the next, and the next, looking for the one — the one, finally — who might cure the misery they’ve inflicted on themselves. Increasingly unhappy, yet increasingly convinced that they deserve to be.

And this follow your heart to happiness situation is alive and well in the church today. Marriage-minded Christian men who have prepared for husband roles are surprised to find that there is often little or no difference between Elise and the Christian women the church produces. Christian men who desire to invest in a marriage that is stable, productive and influential have nowhere to turn for a wife who is able and willing to help. In my experience, the problem with happiness-focused women who delay marriage is never discussed in churches from the pulpit. The “good men to marry” that today’s 30-something women are looking for were plentiful back when those same women were in their early-to-mid 20s.

The new “Marriage Story” movie is a false picture of divorce

I think Sean McDowell is the best scholar to recommend to people who are interested in getting better at defending their faith. He has a splendid wide-reaching worldview, and conservative positions on controversial issues that other apologists won’t touch. He tweeted out a very interesting article from Suzanne Venker, where she reviews a new movie.

You might remember that Suzanne Venker is a pro-marriage writer who thinks that radical feminism has harmed women, and discouraged men from marrying. Here is what she had to say about the new feminist movie “Marriage Story” in The Federalist.

“Marriage Story” is billed as an intense drama about a stage director [Charlie] and his actor wife [Nicole] “who struggle through a grueling, coast-to-coast divorce that pushes them to their personal and creative extremes.” Although the couple has an 8-year-old son, the focus of the film is… about Nicole’s feelings, Nicole’s choices, Nicole’s needs, and Nicole’s desires. Charlie just goes along for the ride. What choice does he have? Based on a 2017 report by Stanford’s Michael Rosenfeld, this story seems to align with divorce trends, as women initiate 69 percent of divorces in the United States.

Indeed, “Marriage Story” is a predictable feminist screed. Its message couldn’t have been more glaring if it tried: Marriage is a jail sentence for women. If you’re not happy, leave. Oh, and take the kid with you. And while you’re at it, you might as well sabotage your husband’s livelihood, forcing him to uproot the life you both built and move across the country in order to be able to see his son for half the amount of time he normally would, thereby irrevocably altering the course of this father-son relationship — particularly since Nicole’s new man has entered the equation.

[…]What you won’t learn is that “Marriage Story” beautifully demonstrates the madness of modern-day childhood. No one’s supposed to mention that because to look at what’s happened between Charlie and Nicole through Henry’s eyes would destroy the narrative. To focus on what writer and director Noah Baumbach wanted to — “telling a love story by doing it in the course of a divorce” — it is crucial to dismiss Henry’s needs, because to a child, divorce is no love story.

By the way, speaking of children’s rights, parents should definitely read Katy Faust’s latest article in The Federalist.

I wanted to suggest a much better movie about divorce than “Marriage Story”. When I was young, I went through this phase of wanting to grow up very fast. I just could not stand being around people my own age, with their obsessions with popularity and fun. So, I got myself a white collar job and started renting every classic movie in the movie rental place. Two of my favorites were “Kramer vs Kramer” and “Ordinary People”. They made much better movies back then. Kramer vs Kramer is the one about divorce which I think accurately portrays the effects of divorce on children.

Here is the summary from the far-left Wikipedia: (I’m leaving out the ending)

Ted Kramer (Dustin Hoffman) is a workaholic advertising executive who has just been assigned a new and very important account. Ted arrives home and shares the good news with his wife Joanna (Meryl Streep) only to find that she is leaving him. She leaves Ted to raise their son Billy (Justin Henry) by himself. Ted and Billy initially resent one another as Ted no longer has time to carry his increased workload, and Billy misses his mother’s love and attention. After months of unrest, Ted and Billy learn to cope and gradually bond as father and son.

Ted befriends his neighbor Margaret (Jane Alexander), who had initially counseled Joanna to leave Ted if she was that unhappy. Margaret is a fellow single parent, and she and Ted become kindred spirits. One day, as the two sit in the park watching their children play, Billy falls off the jungle gym, severely cutting his face. Ted sprints several blocks through oncoming traffic carrying Billy to the hospital, where he comforts his son during treatment.

Fifteen months after she walked out, Joanna returns to New York to claim Billy, and a custody battle ensues. During the custody hearing, both Ted and Joanna are unprepared for the brutal character assassinations that their lawyers unleash on the other. Margaret is forced to testify that she had advised an unhappy Joanna to leave Ted, though she also attempts to tell Joanna on the stand that her husband has profoundly changed. Eventually, the damaging facts that Ted was fired because of his conflicting parental responsibilities which forced him to take a lower-paying job come out in court, as do the details of Billy’s accident.[3] His original salary was noted as “$33,000 a year” (equivalent to $114,000 in 2018), whereas he was forced to admit that his new salary was only “$28,200” (equivalent to $97,000 in 2018), after Joanna has told the court that her “present salary” as a sportswear designer is “$31,000 a year”.[3]

The court awards custody to Joanna, a decision mostly based on the Tender years doctrine. Ted discusses appealing the case, but his lawyer warns that Billy himself would have to take the stand in the resulting trial. Ted cannot bear the thought of submitting his child to such an ordeal, and decides not to contest custody.

I come from a legal immigrant family of non-whites, and there just WAS no divorce anywhere in our family. We’re half Muslim and half Hindu, and we just don’t divorce. There was a lot of fighting in my family growing up, but divorce was out of the question for my parents. But I remember having to deal with the violent tempers of boys in my public schools who had divorced parents. Divorce really hurt those kids. That’s why I try to blog about it here – the Bible is against divorce, and I want to explain to Christians why God’s rules against divorce ought to be respected.

I’m not going to link to studies here about how divorce affects children, because I’ve done that in other places. I just wanted to let you know that feminism is strong in our culture, and they want to make divorce into a creative adventure. Don’t let movies sway you away from what the Bible teaches. And when you defend what the Bible teaches about divorce, make sure you have the facts about radical feminism’s promotion of divorce and how divorce affects men and children.

I recently caused an uproar on my Facebook page by saying that even if the perfect woman showed up right now to marry me, I would not pursue her because the critical time where the woman could have applied maximum youth, beauty and fertility as a wife to make an impact on my education, early career, health, and finances has passed. A younger woman develops value to her husband precisely by applying herself to him and to her family in these critical early years. Men who have experienced this self-sacrificial love and support are loyal to their wives even after their wives lose their youth and beauty. Why? Because the men know that they are much better than they could have been, having enjoyed that early investment of value made by their young wives.

As Christian writer Matt Walsh notes in a recent article at the Daily Wire, this “follow your heart” focus on happiness in women is lethal to marital stability, and men know it.

There was an article in Cosmo this week with a title that summarizes all that’s wrong with Cosmo and modern society as a whole: “I eloped at 25, divorced at 26, and dated my way across Europe all summer.” Of course, by “dated my way across Europe” she means that she slept with half the continent.

The author, Elise, says she “started fighting” with her husband and within a few months they both decided that their differences were irreconcilable. Despite counseling, she says, “neither of us was happy.” So, exhausted from 12 whole months of marriage, Elise embarked on a voyage of self-discovery and STD cultivation. She met random dudes in half a dozen countries and had sex with them, learning quite a lot as she went, though she can’t really explain what exactly she learned or why sex was a necessary component in learning it. Finally, she came home and started dating some other guy. The end.

Well, not really the end. 20 years from now I’m sure we’ll get the follow up article: “I’m alone and miserable and it’s everyone’s fault but mine.” After all, you may be able to fill the emptiness in your soul with frivolous sex when you’re young and physically desirable, but that phase is fleeting. People who don’t want to “waste” their beauty and youth on a spouse, so they waste it instead on strangers who don’t love them or even care what happens to them tomorrow, will be shocked when a tomorrow comes where even strangers aren’t interested anymore. This is where the single-minded, utterly selfish pursuit of “happiness” at all costs inevitably leads: to rejection, despair, and a quiet, unnoticed death on a lonely hospital bed.

As Elise helpfully demonstrated, “do what makes you happy” is poison in a marriage. Many a vow has been broken because one or both partners decide to chase “happiness” instead of commitment, fidelity, and love. “I deserve to be happy,” reports the legion of serial divorcees, as they drift on to the next spouse, and the next, and the next, and the next, looking for the one — the one, finally — who might cure the misery they’ve inflicted on themselves. Increasingly unhappy, yet increasingly convinced that they deserve to be.

And this follow your heart to happiness situation is alive and well in the church today. Marriage-minded Christian men who have prepared for husband roles are surprised to find that there is often little or no difference between Elise and the Christian women the church produces. Christian men who desire to invest in a marriage that is stable, productive and influential have nowhere to turn for a wife who is able and willing to help. In my experience, the problem with happiness-focused women who delay marriage is never discussed in churches from the pulpit. The “good men to marry” that today’s 30-something women are looking for were plentiful back when those same women were in their early-to-mid 20s.
