NY man arrested for defending home with firearm

George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious “MS-13.” He said the whole deal happened as he was about to drive his cousin home.

“I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, ‘Can you please leave?’ Grier said.

Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house.

“He starts threatening my family, my life. ‘Oh you’re dead. I’m gonna kill your family and your babies. You’re dead.’ So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass,” Grier said.

Grier was later arrested.

[…]Police determined Grier had the gun legally. He has no criminal record. And so he was not charged for the weapon.

Only the criminals can have guns, not the law-abiding people. Because criminals are victims of social inequalities, and the law-abiding people cause crime by having “more” than the criminals.

  1. As the saying goes, “Better to be judged by twelve than carried by six.” Hopefully a court will see all the circumstances involved and find him not guilty.

  2. He wasn’t arrested for having a gun, he was arrested for discharging it within city limits. The laws have always been clear, you can’t shoot at people because they say things you don’t like. If he isn’t ready to shoot someone, and he definitely wasn’t – people who are ready don’t shoot warning shots – in situations like the one described it’s dumb; you lose ammo and precious reloading time.

    And, if these “gang members” really are from MS-13 – he better start looking to move since his scare tactic isn’t going to scare a gang like that, especially since they now know he won’t shoot them.

    1. I don’t mind that the cops checked in to see what was happening. If that meant they had to hold someone in order to get the story, to hold the guy who fired the weapon is a good start. That’s fine. But his firing of the weapon was justified as he has a legitimate suspicion of impending harm. He had the smarts to fire warning shots and that should be taken into account. They were fired in a relatively safe manner as it was his property and the possibility of hitting something that could cause a ricochet is minimal since he knows his own lawn. If he suffers any legal recriminations it would be a great injustice. The purpose of having a weapon under the 2nd Amendment would cover this situation perfectly.

      As to whether or not a nasty gang would retaliate, I would suspect that since he fired the weapon at all, they would likely assume the chances of him being willing to fire AT them is now higher than it would have been had he never fired it. Of course they might be stupid. I hope he doesn’t have to find out.

      That’s an interesting comment. A good citizen has to move because the government can’t protect him and make him feel secure? Instead, he was arrested for trying to defend his home.
